My name is Debbie Koç
I used to work for L&M properties in Bodrum where I sold apartments from off-plan on this complex. To things out of our hand the developer went bust and was left with no funds to complete the complex. ( This can happen in any construction all over the world ) Its not a nice thing to happen to anyone. But this is not in the hand of any estate agent unless they are involved with the construction. ( Which no estate were).
An nor was kemaloglu Insaat.
The land owner gave her land to the developer and in return she had a share in the apartments of the complex ( this is a normal pratice in Turkey).
This complex was uncompleted due to the developer going bust. A first meeting was held back in March on the complex to try and come to a soulotion for this problem.
During this meeting I was attending on behalf of clients at L&M properties- but still listened to problems from residents present who had bought through Sunshine Turkish Homes. ( To find that some clients who had bought through them had still not got there Title deeds) - I offered to help them with this process even though there estate agents should have been dealing with this.
At this meeting it was decided that we three quotes from diffrent builders and handed into Tony Perin and Phil Drew to view. Following this L&M properties collected a quote from Kemaloglu Builder as requested and Sunshine Turkish homes collected a quote and a third quote was collected from Atlas Estate agents in Gundogan.
We were then issued another list from Tony Perin and Phil Drew with a final work list of Jobs required on the site. All three quotes were reviewed and sent back to the clients.
Following this each client had there choice to make of which quote they wanted to go with the majority vote went in Favour of Kemaloglu Insaat.
Many diffrent reasons this company was voted in --
1) This company is already in construction in this area.
2) The price of the quote in comparision to other quotes.
3) His work had been checked from several residents on behalf of the other residents.
4) Another reason is that this builder would be still working in this area on other projects and would be available should there be any problems with any of the building work.
Another comment which I would just like to add at this stage.
This complex has not habitation cert therefore has no water & electricty supplies to the complex. This builder has been providing water & electric from his building site for over a year to enable property owners to use there apartments. ( And paid for this out of his own pocket).
Again not his responsabilty to provide this....
Following all the building quote I recived over 23 qoutes for this builder which was over the majority as there are only 36 apartments on site.
A meeting was then called to form the commitee for the complex on the 31.05.08
held at the site office where both the land owner and the developer was present along with estate agents and residents that were attending on behalf of other UK residents.
Attending on behalf of the UK residents were Pat Lefuvre and Richard Gane .
The meeting was also another lawyer present who was there to represent 16 residents from the UK.
The meeting didnt go very well at no fault of mine I was just present on behalf of our clients.
Three names went forward for the commitee Pat Lefuvre , Sharon Hewitt and myself.
I was voted in with the majority of votes which I was not pleased about as I did not want to be part of a commitee on my own. Things got hot tempered I was acused of it beig fixed on behalf of the Land owners votes. I then sated I wanted the other two member present on the commitee with me which has been done.
At this meeting it was decided that with the majority votes and other reasons that Kemaloglu would be given the building contract to complete the complex.
The following day I was asked by Richard Gane who was out here on behalf of residents from the UK to meet and walk around the site with the builder to take a look at the work that was going to be done and add in any works he thought was needed.
( As requested extra works a new price and quote was made up )
Bearing in mind some of the extras were not added to the cost by the builder.
It was agreed that I would collect the shares of the funds from the Turkish residents and other nationalities and Richard would go back to the UK and deal with the Uk resdients. ( Of course people are not going be happy as no one want to pay further funds when they have bought a property which has not been completed)
But this is the only of resolving this situation on this complex with out going down the long road of court cases and still paying funds out for that route.
Following this a contract was draw up with the builder as per updated list of work and costs .
People in the Uk before transfer the funds wanted to see that Fatma the land owner had paid her share of the costs for her apartments which she still owns on the complex - which was made and I forward the proof of payment over to the UK residents as requested.
The contract with the builder states 40% of the Funds on start - out of good will the builder trusted the residents of this complex and started the building work before these funds arrived. ( He didnt have to but he )
The complex book and notes of the meeting were written up with a lawyer so that nothing ilegal was present in the book.
I in the meantime finished working for L&M properties which I had planned to do so before all this happened due to wanting to do my own adventures ( which some of the clients that I sold to on this complex were aware off).....
But still carried on my duties to these clients.
I have the complex intrests and residents intrests at heart nothing else this has always been the case.
Just like the owner on the site I want to see it completed and residents to beable to enjoy holidays on this complex.
At present very little residents have stuck to the contract which has been signed between the complex and the builder. ( Like any builder would be upset at this espically when over the last year he has tried to help on this complex where needed.
For example providing electric water, helped with residents snag lists, provided staff to the site office to protect the complex and residents apartments.)
Another subject which has been bought up on lots of occassions is the fact that I have a private relasonship with the Builder this has nothing what so ever to do with anyone else and never comes in to our working enviroment. Millions of people all over the world have partners that they work with....
I feel that its only natural that residents are going to have anger and not want to pay any funds to complete the site. But I also need to state if you want to be anger at someone be angry at the developer who was responsable for all this not the people who are trying to help solve the problem.
I have offered my help to clients with no title deeds - But if these people dont wish to contact me for the help on offer what would like me to do ???? ( This is not my resposability all clients which we sold to at L&M properties have there title deeds and no problems)
I can only offer my help.
Anything requested from angry residents I have tried to deal with in regards to yes owena & Tony requesting that the land owner should pay for there share I have forward all requests over but if she is not willing to pay I can not do much more on that side.
I have to protect the complex and support the residents who are generally keen on getting this complex completed. - I could spend all day listening to angry people but this is no soultion to getting the complex completed.........
I have not threated anyone regarding funds , but like anything I have a responability to this complex and have to do everything legal to protect this and other clients who just want to see the complex completed.
If the builder decides that he doesnt want to give his supply of water and electric to the complex he can not be made to as this is his supply not arrina 2.
Anyone who would like to make comments on this please feel free to Im here and contactable I have nothing to hide and have nothing ilegal...
But if you want to punish someone for the things that have happend on this complex you should be blaming who was responsable Memhet Kilic the developer not people who are trying to help.
