Akbuk - Proposed new sewerage system

A meeting will be held in Liman Bar Akbuk this Friday 26th April at 6pm regarding the above proposal. All Akbuk residents welcome.

Hi

We hold meetings every six weeks for all residents of Akbuk. We have guest speakers covering a variety of topics plus local Solicitor, journalist and the Environment group attending the meetings. Next meeting is on Saturday 25th May at 5.30pm in Liman Bar.

Proposed new Sewarage System—Meeting held on 26th April 2013—Thanks to Faruk Haksal for holding this meeting and to Sami Isek for coming over to Akbuk at short notice to translate.

Every home owner in Akbuk will receive a letter from the Council regarding extra payments on water bills. According to Turkish Law the Council cannot charge for anything until the work is completed, hence the Council are putting this money under the umbrella of water bills and not for the proposed sewerage system. Whether valid or not, it is a matter of question whether this work will actually go ahead. They can legally charge money once the project is completed and you will need to pay this within 2 years either as a lump sum or in 4 instalments. If they are taking this money under the water bills who is to say that they won’t ask again for the proposed sewerage system. The Council have to pay a proportion of the money (50%) into central funds before the full monies will be released. According to the Mayor’s recent statement half the money will come from the Government and the remaining half from residents. Advice at the moment is DO NOT pay this money, you do not have to pay until May 2014 and who knows what will be happening by then. Obviously with Akbuk council ceasing to exist next year Didim council will become involved as well as Aydin so all a bit confusing at the moment.
They CANNOT stop people crediting their water cards as first payment not due yet. Unfortunately those people that have already paid and have received a receipt will not get reimbursed as you have basically agreed to accept this by taking the receipt. The payments do vary as well depending on the size of the property.
We do have a document available in Turkish which people have asked us to get translated, will cost this up and then see how many people are interested in paying for a copy but this has the legislation on it that they can not ask for contributions until the job is finished, will send details of costs etc asap.
As you know Akbuk Council will cease to exist next year and we will become part of the Metropolitan Council in Aydin. Faruk has spoken to the Mayor in Aydin who supports this new sewerage system and it is on her Agenda to proceed with these works (although there will be elections soon but as far as we understand the Aydin Mayor has good chance of being re-elected).
One point that was mentioned is that the amount of money Akbuk Council owe to Central Government is similar amount to that which they are trying to collect under this new sewerage project!! Maybe we will try and get the Mayor along to next meeting for his views!

Many thanks for the update on the meeting. Nice to know that I am not legally obliged to pay yet, as I had no intention of doing so.

I have paid enough payments, to this council, which I should have not had to.

We are out on the 7th. May, when we will no doubt be presented with the latest charity envelope.

Hi, Many thanks for the update. We are over in June and would normally make going to the council to pay the council tax one of our first jobs. Does anyone think that they will insist we pay this sewage tax at the same time???? We don't have a water meter bill as we pay the builder still. Thoughts anyone..........

We had a new canalisation system put into Datca about 4 years ago now. Every household paid a standard 265TL. There was a separate charge for connection from the property to the main sewer in the street which varied by distance etc. At that time we had an apartment in a small block and we came out in late summer after the work was done.Friends had told us the cost so we were ready with the money but the apartment manager asked us for 330TL. He said he had already paid for us, so we asked if the belediye had added a late payment penalty, and for a copy of the receipt from the belediye. The dumbo gave us a receipt which said 265TL, from an envelope which had lots of receipts for the other apartments. A neighbour who was translating for us suddenly realised that he had charged everyone 330TL, including her, and she was furious. When we did the maths we realised that he had increased everyone else's charge to cover his own! Moral of the tale, find out the cost in advance from the belediye, and get a receipt.

Maybe someone on this forum will translate this in to Turkish......

"I have taken legal advice and I am not obliged to pay for this until the work is completed, I understand that the work may commence in May2014"

Then just get it printed off and show it to them.

Yaklaşık olarak ünite başı 1000 TL civarında tahakkuk ettirilen katılım payı borçlarının ödenmesi için 31.05.2014 tarihinden başlamak üzere, iki yıl ve dört taksitte söz konusu parayı ödeme hakkına sahip. Ama para peşin ödenirse, % 25 indirim var.

Akbük Belediyesi "giderayak" geçmiş döneme ait su katılım paylarını toplamak için düğmeye bastı.

Hedef, geçmiş su katılım paylarını toplayarak kanalizasyon şebekesi inşaatına yatırmak…

Akbük'ün kanalizasyon şebekesi yapılması birçok çevre sorununu kökünden çözecektir. Bu projenin gerçekleştirilmesi Akbük için çok önemlidir. Ancak, bu kadar zamanı boşa harcadıktan sonra geriye kalan kısa süre içerisinde gerekli olduğu söylenen 17 Milyon Türk Lirası'nı toplamak oldukça zor gözüküyor.

İLK TAKSİT ÖDEMESİ 31.05.2014 TARİHİNDE…

Belediye'nin gönderdiği tebligatlarda tahakkuk ettirilen tutarın ödemesinin iki yıl içinde ve dört taksitte yapılabileceği yazılı… Ancak vatandaş bu tutarı bir ay içinde öderse % 25 tenzilat yapılacak.

Bu durumda, peşin ödeme yapmayanların ilk taksitini 31.05.2014 tarihinde ödemeleri gerekiyor.

Bu tarih ise, Akbük Belediyesi'nin kapanması tarihinden sonra…

Demek ki, önümüzdeki yıl kanalizasyon ihalesinin yapılabilmesi için tüm Akbüklülerin peşin ödeme seçeneğini kullanması gerekiyor.

Peşin ödemeler ile 17 Milyon Türk lirası toplanamadığı takdirde ihalenin yapılabilmesi imkânı fiilen ortadan kalkıyor.

İKİ DEFA AYNI PARAYI ÖDEME RİSKİ

Konunun vatandaşın cebini ilgilendiren bir diğer yanı da, ileride kanalizasyon inşaatı için kendisinden yeniden para talep edilebileceği sorunu… Çünkü, ödenecek olan paralar İller Bankası'na olan su borcu ile ilgili… Akbük Belediyesi kapatıldıktan sonra kanalizasyon şebekesini yapacak olan Büyükşehir Belediyesi Akbüklüden bu hizmete katılım payı isteyebilecektir. Bu durumda da Akbüklü vatandaş, "Bu parayı ben ödedim," deme imkânından da yoksundur. Çünkü ödemiş olacağı para, su ile ilgili katılım payıdır. Böylelikle gerçekte kanalizasyon için Akbüklüler iki defa para ödeme riski ile karşı karşıya kalacaklardır.

Bütün bu sorular ve daha niceleri Akbüklü vatandaşların kafalarını daha şimdiden karmakarışık etmiş durumda…

NİÇİN BU KADAR BEKLENİLDİ?

Tüm Akbük halkının peşin ödeme seçeneğini kullandığını düşündüğümüzde ise, toplanması hedeflenen 17 Milyon Türk Lirasının tümü toplanamıyor.

Çünkü yasal olarak toplanması mümkün olan su katılım payı toplamı, 15.800.000 TL…

Akbük halkının tümünün peşin ödeme seçeneğini kullandığını varsayalım. Bu durumda toplanması mümkün olan toplam para bu tutarın %25 eksiği olacak. Yani, sadece 11.850 TL…

Oysa, İller Bankası kasasına peşin olarak yatırılması gereken miktar 17.000.000 Türk Lirası…

İller Bankası bu miktar kendi kasasına girdiği takdirde geri kalan 17.000.000 TL'lik hibenin değerlendirilebileceğini söylüyor… Yani, ifade edildiği gibi ortada Akbük Belediyesi'ne tahsis edilmiş, kesinleşmiş bir hibe de mevcut değil!

Bütün bu hesaplar Akbük halkının tümünün peşin ödeme seçeneğini tercih etmesi ve bu parayı da 1 ay içinde ödemesi halinde geçerli olabilecek.

Akbüklü, ilk taksitini 31.05.2014 tarihinde olmak üzere, tahakkuk edilen tüm tutarı iki yıl içinde ve 4 taksitte ödememe hakkını kullandığında ise, proje tümü ile suya düşüyor. Çünkü Akbük Belediyesi, ilk taksitin ödeme tarihinde zaten kapatılmış olacak…

Bu durumda vatandaş soruyor:

- Niçin bu kadar önemli bir konuda bu kadar vakit kaybedildi? Ve tam da yumurta kapıya gelmişken böyle alelacele hesapsız-kitapsız bir işe kalkışıldı?.. Yasalara ve vatandaşın kesesine uygun daha uygun, gerçeklere ayağını basan ve kimseye zarar riski yansıtmadan bir çözüm bulunamaz mıydı?

SU PARASI TOPLAYIP, KANALİZYONA YATIRMAK HUKUKA UYGUN MU?

Ayrıca bir diğer sorun da, toplanacak paranın geçmiş su projesi ile ilgili olup, kanalizasyon şebekesi inşaatına harcanacak olması. Bunun böyle olacağı Akbük Belediyesi'nin son Faaliyet Raporu'nda açıkça yazılı… Benimsenen bu yöntemin ne kadar hukuka uygun olduğu da tartışma konusu.

Ayrıca, su borcunun tümü dahi toplanacak olsa, İller Bankası'na peşin olarak yatırılması gereken 17 Milyon Türk Lirasını karşılamıyor. Çünkü toplam su borcunun, 15.800.000 TL olduğu ifade ediliyor. Ancak, bu paradan geçen zaman içinde ödenmiş olan kısmın da düşülmesi gerekiyor…

BANKA ÖDENEN PARAYI BORCUNA SAYMAYACAK MI?

Bir diğer konu da, Akbük Belediyesi'nin geçmiş su projesi nedeniyle İller Bankası'na olan borcu…

Konu ile ilgilenen sorumlu yurttaş soruyor:

- Vatandaştan su borcu olarak toplanan bu paralar İller Bankası'na yatırıldığında söz konusu banka bu paraları Akbük Belediyesi'nin su borcuna mahsup etmeyecek midir? Bunun bir garantisi var mıdır?

MUTLAKA BİR ÇÖZÜM BULUNMALI…

Akbük Kültür ve Çevre Derneği yetkilileri ise, kanalizasyon şebekesinin Akbük için çok önemli olduğunu ve mutlaka bu sorunun çözülmesi gerektiğini vurguluyor ve konunun çözümü için yasalara uygun ve vatandaşa zarar vermeyecek makul bir çözüm bulunmasını istiyorlar.

Hi

I have just completed on our new property in Akbuk paid all fees due and two weeks later ( a couple of days ago) recieved a note from the developer stating.

'Hope you are well.I am sure you have heard that Akbuk Council is charging fees from each apartment for the new sewage system .We had to pay 333 pounds while we are transferring your deeds .I know we were responsible for title deeds ,water &electric transfee costs but this is your responsibility as you took the ownership of the property September 2012 .You can pay this now or I can add this on to your maintenance bill which is due august'

I never agreed to pay this or was not notified by the developer. it seems a bit strange to tie this matter into deeds delivery and this was certainly not requested when I picked up the tapu in person 3 weeks ago Can anyone offer advice
