Complex Management Plans

Anybody got any experience of taking people to task over contravening
rules specified in the Complec Management Plan, that is lodged at the Tapu Office.

Can you , for example get the Zapita involved

What you can do & is needed is make sure that ALL owners are singing off the same hymn sheet. Thats your starting point..............tackle the issue en-bloc. A lot of these builders work on the basis of divide & conquer.

There are plenty of people on here who have been down this road (a road they have had to pay for as well). I am sure you will get some proper answers.

I agree with Spurs and that's where it all unravels.

Unfortunately the 'United we stand' bit is outweighed by Brit apathy. Much moaning is done, but when push comes to shove try finding enough people with a backbone.

I believe that 80% of owners would need to be in favour of changing the management plan any changes would need to be discussed and voted on at a properly constituted meeting and any changes would need to be notarised

You would need a meeting of owners to take enforcement unless you have given the committee powers to act

You do not need a meeting for most transgressions .The Committee of Management will be empowered by by your Management Plan which is deemed to incorporate the Condominium Act, in particular Chapter 4 .

it is difficult to comment without knowing the transgression , who is the offending party (owner/contractor etc) , or what your Management Plan says . Have you been able to obtain a copy of this and the Condominium Act?

As far as I am aware, when a management and committee is formed, the Management Plan must be lodged with the Tapu Office.

If this has been done, and you are unhappy with the way it is being run, you can go and make a complaint at the Tapu office.
Remember though, that if your complaint is found to be warranted, your Manager and all Committee Members will face a fine. So ask yourself ...is the complaint worth making possible enemies within your Management, who can often be your nieghbours?
If you can answer, yes....then go ahead.
