Aidat debts

Apologies if this has been covered before.
If an apartment is sold with aidat debts, and the new ( buying) owner is aware of this, who is then responsible for the debt after transfer of Tapu?
Can anybody point me towards a point of law that covers this?

all debts should have been paid before sale took place .the owner of the Tapu is responsible for any debts after the sale...

As stated above always check the Tapu before finalising the purchase as you wıll inherit all debts with the Tapu. Go to the Tapu office they will give you the ref no for the regulatioın/law covering this.

Debts are attached to the Tapu and the responsibility of whoevers name is on the Tapu. until paid . Fairly common here that debts attach to the property not people.You have to do similar checks when buying a second hand car to ensure that there are no outstanding fines or car tax

Unless there has been a court judgement against the debtors I don't see how the debt will be registered against the title deeds.
I only know of 3 ways that debts can be registered.
1. With the owners consent as in the case of a loan or agreed debt.
2. By a government/council department for money owed.
3. By a court order.

If there are others ways I'd be interested to know.
