New Laws for buying & selling 2019

Taken from Voices newspaper this morning....
A CHANGE has been announced by the government over foreigners buying and selling property in Turkey.

The change to the law was brought in at the weekend.

Before the law change, foreigners could buy and well properties using their tax cards.

Now the TAPU office requires a foreign ID number starting with 99Ö when foreigners buying or selling property.

The Head of District confirmed to Voices that foreigners will now have to go to the Population Registration Office to get this number. THERE IS NO CHARGE FOR THIS and they have to produce a valid passport to get the number.

For Didim, the Population Registration Office is to the far left hand side on the ground floor within the Kaymakamís Office (which is across the road from the Didim Law Courts).

To get this foreign ID number foreigners DONíT need a residency permit. This is important.

Most people think that they need a residency permit to get this number. They DONíT.

They have to go to population registration officeís foreigners department at Kaymakamlık and get this number.

It is not clear yet whether this number can be taken for a Power of Attorney (POA).

For now, the person who wants to sell or buy has to go to the population registration office in person to obtain this number

I read that somewhere i suppose it keeps a check on who is who . I hope you do not mind me putting this on your post. The new government pricing system is getting abused already met a couple yesterday new house no minimum price survey 3000 tl on tapu ,How does the tapu office allow this if it is run by the government ?

I have read this 3 times and cannot understand it. Could you please explain what the abuse consists of and who is the abuser?

Thanks for posting shash.

Not too surprised about this requirement, I think it has been talked about for a while but this news hasn’t reached the Tapu offices in our area yet (Dalaman & Ortaca in Muğla). We completed a sale yesterday with just tax numbers. Admittedly the buyer and seller weren’t actually present, it was a local lawyer who had the POA for the seller and we had the POA for the buyer (yes, I know, never give your agent a POA!) Anyway it went through without a hitch.

Thought we had better call the Tapu office anyway to check if they did have any info as we have another sale to complete on Friday, this time a UK seller and Turkish buyer. So far the offices have not received instructions yet. Luckily we took the seller to Fethiye to get his YK number today, so he can update his satellite internet account with Speednet, so he will have one if it is needed on Friday.

(Speednet are a popular local provider and lots of foreigners have been able to sign up for an account with just their passports until a couple of months ago. Now Speednet will only give 2 monthly packages per year unless customers update their account with YK number).

In view of this we spoke to the GŲÁ office in Muğla when we were there a couple of months ago and they confirmed that property owners, or those with a notarised contract, could apply for a number with just their passports and several people went up there to get one. All seemed find until one of these people tried to buy a second hand scooter and his number was not recognised on the system at the Notary office. He was unable to complete the sale at the time.

Shortly after we got the info from Muğla, we became aware of a different requirement when applying for a number through the Fethiye GŲÁ office. In Fethiye you need a copy of your Tapu, an ‘adres tespit formu’ from your local Belediye, which includes your ‘individual’ address code, your passport, a passport copy, a biometric passport photo and a completed form, given to you at the office when you arrive. We did this today with our ‘Friday seller’ and will now have to ring up the office tomorrow to get the number. Once we have the number this chap will need to return to the Fethiye office to sign his address paper! Apparently this can’t be done until the number is issued. We also heard the GŲÁ İdaresi had plans to issue non-residents with a similar card to the residency permit cards, which would include, among other things the YK number and a photo of the owner, however that plan is currently on hold.

Unfortunately this is also not quite the end of the story. The YK number is only valid for the length of your tourist visa and needs to be updated each time you get a new visa. Supposedly it is not an issue though. You simply turn up at the office with your new visa and they will updated your records.

It is all a bit of a faff, but will probably be streamlined when they have worked out how to deal with the unnecessary complications.

(Just hope that your Belediye haven’t cocked up and given several houses the same address code. If they have, you are in for a complete nightmare which makes the above seem like child’s play!)

Of course TİT and your area may be different!

This will obviously make it much easier for the Turkish authorities to advise the purchasers home tax authorities of the purchase of property. And of course questions will follow regarding the source of funds.

I thought the new system a foreigner buying or selling must have a cert with the minimum sale price ,They are still selling houses to foreigners without these cert.So the builder is abusing the law There was a post on here about a month ago but could not find it .

Since March this year it is a requirement to have an ‘Expert Report’ from a Government approved company for the completion of a sale where either party is non-Turkish. This 20-odd page document includes all the details of the property, the plot, the plans, the permissions & licenses etc. It also includes the companies estimate of the property’s value and this value is based on a survey of prices with local agents, details of which are also included in the document.

The document is presented to the Tapu office at the time of the Tapu transfer and then handed to the buyer when the transfer is complete (presumably copied by the Tapu office beforehand).

In addition to this you still have to obtain the usual valuation from the local Council which has always been on the low side, compared to the prices paid, and is the lowest amount that can be declared. It is still accepted by the Tapu office to declare this price, although I find it hard to understand why and why a local council would give a value of 3,000TL in the instance mentioned above and even harder to understand why the buyers would have agreed to this amount being entered on the Tapu, apart from the obvious reason to avoid paying the full tax amount.

(Interestingly the expert valuation given on Monday for our sale was actually greater than the price paid, given the exchange rate on Monday, but we still used the expert valuation for the purposes of the Tapu transfer and the Tax payable. Expert price 635,000TL. Tax paid 19,050TL. The council valuation was 168,077.54TL)
