For clarity, owners took over the management, legally in October 2017, so we are operating under the condominium law. The builder has not paid for last year and for 6 months of this year. Debt has been reported. Our next step is to vote to now ask the court to take charge of the properties so we can recover his debt monies. I understand we have to pay the court to do this (4,000-6,000tl) is this correct? And do we get the money back if the property has been sold.
Before October 2017 builder was managing the complex, but with no accounts, no owners meetings etc.. management was not legal.
Also, two owners have current court cases against him (he lived in one of the properties for over three years without the owner knowing!!!). Would this stop him from taking over the management? as there would be a conflict of interest with the two owners?

Sorry Afletch1 for digressing on your thread but if I could just ask one more question to those more learned than I,is it correct that 15 days notice must be given to owners of any AGM.

All developers have to submit a management plan to the authorities before the building starts you will be operating under that plan .
The condoning law takes over when the p!an doesn't cover a legal issue,you can obtain the management plan from the Tapu Office
