Criminal Case against Civil Case

Hiay this is an answer I have back from our present Lawyers, it is complex and
is intended for our case, however I am sure it brings some light to the questions of why the fraud element for theft is not brought by the Public Prosecutor. I have had to delete the names and a few of the details for public exposure.

"Technically it is possible to bring a claim against them in the criminal courts. However practically it is a pointless exercise as by bringing a criminal case will not provide you any compensation or help you to get your monies back. Furthermore the public prosecutor would most probably drop the criminal suit stating the claim should be brought before the civil courts.
I understand your frustration however bringing a criminal case will not really stop them. On the other hand, bringing a claim against them before the civil courts, we could ask for injunction to freeze his assets, bank accounts, properties etc."

I cannot comment any further however it has been explained to me in detail.
I hope this can clarify some discussions from last night.

So you say, after all, there is no need to take any case to the court, it will not help, or to say, no protetcion at all. No money back. They can do whatever they like to almost.

Hi tony and Mary,
I am taking both a civil and a criminal case, the papers for my criminal case have been lodged and I am waiting for proceedings to start, at the same time we entered into a civil case . My solicitor recommended that we do both, charged me one fee to cover civil (to try to get my money back) criminal and to include an appeal if necessary. whilst the information is correct that the criminal case will not get your money back, if I have any chance at all of putting those thieving bastards who have my life savings and who are still trying to screw money out of desperate people, in jail then I'm going with it. it's not costing me anything extra.

İ had a criminal and civil case going on together. The criminal case was put in writing which i gave to the judge. The civil case was written up at the police station and my lawyer took them to the judge to merge the 2 cases. The civıi case cost 5000 tl of which half was wanted upfront.

Seem to read about plenty of cases but not much in the way of victories

Mine did not get to court as we came to a agreement. But one thing my lawyer said was that there is no point in a civil case if the person you are taking to court has no money.

I agree with everything your saying, however it has now got so complicated because of the miss handling of 2 previous Lawyers that it is now all smoke and mirrors.
Whilst there in October 2009 Tony and I learnt that the villa had been sold on again to someone else for a small amount of money, this is what led Tony to have his seizure. We now have a situation which has to be handled differently than previously thought.
As Yalimart says does anyone ever win these cases? Are we just throwing everything at it but in a no win situation.
I am determined to fight and jail would be what we want for the low life involved. We shall have to see what is thrown at us next.

I dont think I have heard of any sucessful court cases in the time I have been a forum member, so, please if you have a happy ending story please post it. I'm sure it would be a welcome read from all the doom and gloom and I for one could do with a boost. We are half way through our first year of court proceedings and it dosent get any better. If and when we win we will sing it from the roof tops, drinks all round, mega party, champagne and fireworks the works. Can anyone give us
at least a little glimmer of hope.
