Legal Challenge/Registered Site Security Services

Myself and a couple of other owners I know have just found out that an EGM has been held on our site, decisons made, fees decided and we were totally unaware of this EGM having been called. We were in the UK when this EGM was called and thus available to sign any registered/recorded delivery mail that had been sent to us.No invitation to attend was received.

A small few of us are not happy with the way things are being run but there has been no objection in the past as the site management and site maintenance charge is much lower in comparison to complexes around us. However we are being charged for security personnel services that never seem to be around when I am on site and despite the comparatively low site fees if you look at what we are getting and what isnt being done - then it is not as good a deal as one would imagine at first sight.

Do I have a right to challenge the decisions made at this EGM given that I was not notified and if so how do I go about this and what are the charges?. Has any others on here similarly challenged ? If so what was the outcome ?

Other questions I would like to ask surround members experiences of registered/ licensed security personnel provision. Can anyone give me details/ recommendations of any decent sized security companies who are multi based - ie not confined to the Didim area? Also if any members are part an owners committee who run their own site then I would be interested to hear their views about what they consider to be normal charges for registered security staff eg 2 x security staff working 12 hour nightshift and 1 x security staff working 12 hour shift during the day. Or are these registered security staff limited to lesser working hour shifts? If so what would you consider to be a reasonable/ half generous monthly wage for watchman/gateman type staff?

Hi Jonno , welcome to TLF!
Wow, quite a lot of info you need on your first post.

To call an EGM all owners need to be invited and sent registered (or recorded) delivery mail or attached to your Turkey address.Who runs your site? (reply by pm if thats easier) Is there an owners committee? Who's pocket does your maintenance money go into? Is that person, company registered? Do they pay taxes? Did they have your details? If whoever called the EGM can prove they made every possible effort to contact all owners including yourselves then doubt there is much you can do. To call an EGM you need to give at least 14 days written notice to owners.

I'm sure more experienced members will post some more replies regards complexes, committee 'headaches,lol'.

Regards security the basic salary starts at 1000 lira a month so you're looking at a minimum of 12,000tl per annum plus social security for 1 staff.

A lot of complexes around Didim either have glossy paperwork and no real management especially security when it really matters eg Winter months when no one is there or if there's an established management this often seems to go better than enthusiastic owners wanting to do their 'own' thing.

notices have been pinned to my door by PTT on other occasions when they tried to deliver something when I was not around to sign for receipt. Would PTT retain records of undelivered registered letters? OR if being delivered locally would the EGM invitation still be required to be sent via registered post? This is what I am a bit unsure of.

As regards all attempts having been made the management have full records of my email address and telephone address - and previous invitations have been sent to my UK address via registered post. Maybe I have upset them this year?

I am sure the site was managed by the builder but I think it is a legally seperate company now that manages the site - but with links still to the builder if that makes sense? You have raised other questions which I am not clued up enough to answer at present - where would I find those answers - Belediye?

Re the wages you quote - is that for registered security personnel or just gateman/ watchman status?

Yes its a requirement of the Condominium Law . The alternative is everybody signs the proposal which clearly has not happened
