Just A Warning - Residency Permit

Our residency ran out on the 29th of June and not wanting to renew it we left Turkey on the 22nd of June. We then stayed in the UK until the 30th of July and returned to Turkey on a 90 day TOURIST visa. No problems re entering Turkey and we stayed for 89 days and planned to leave on the 26th of October. Arrived at the airport, checked in, went through security and came to the final hurdle presenting our passports to the Police. This is were it started to go pear shaped. We had noticed a lady just in front of us remonstrating with the Police officer about something and he left His box and took her to the Police office. He came back and it soon came to our turn. We gave him our passports and after longer than normal he started to ask for visa. Luckily I had printed ours out although we were not asked for them when we entered the country. I showed him them but he quickly becameannoyed and kept repeating "No, no, residence permit. He could not speak English but I tried to explain residency expired. He just snatched them out of my hand and led us to the office were the other lady had been taken. We were told curtly to "sit down big problem". By this time the lady before us was becoming quite distressed. They said to her "You must pay fine or you will leave Turkey and not come back for five years" She then turned to us and said she had done the same as us but had only been back three weeks. By this time we were totally bewildered and no amount of arguing would change his mind.He kept saying to us "permit expired you must pay big fine"He thought we had stayed in Turkey after our permit had expired.The poor woman was hysterical and I was trying to tot up how much this was going to cost me! Then suddenly he picked up the phone had a quick conversation, turned to me and said "you left Turkey 22nd June bye, bye!! No apology or nothing, he said the same to the woman who was a gibbering wreck by this time.Anyway hope it doesn't happen to anyone else as it was quite scary.

You are not the only ones this has happened to. I have had reports of others being fined for overstaying their expired Residence Permits despite entering Turkey (as they thought) on a Tourist Visa.

It appears the system automatically registers you in on your RP even if you have bought a visa.

The DGMM in Antalya told some people I have been communicating with that whilst they sympathize with the situation and agree the visa should override the permit the simple fact is that it does not and so they must pay the fine on exit.

I was just about to say the same as Akbuk Rob above, but I think the most important thing here is when entering on a 90 day visa after a RP has expired it to make sure the visa print-out is also handed over on entry, and hopefully they will take note that the visa has been used and not just let you through on a expired RP which maybe they wrongly assume you will be renewing.

Just because you applied for a 90/180 day visa does not mean it will automatically be activated on entry.

I agree with you O.F. but I doubt it is that easy or even possible for border guards to override the computer system to enter someone on a visa if there is a RP registered to them.

Computa says Nooooo!

Soooo many RP holders have wasted money on Tourist Visa’s this year believing the 120 day out rule would prevent them from entering. Now we discover that none of those visas were ever activated. It appears they were all ripped off before they even entered the country!

So what happens next year when they want to visit Turkey will they be allowed in on a tourist visa.

It is quite conceivable for someone to be banned from re-entry for up to 5 years through no fault of their own and trying to comply with regulations by purchasing a Tourist Visa & entering Turkey before or within 10 days after their Residence Permit expires.

The DGMM were not helpful in the case I mentioned, it is a situation of the left hand not knowing what the right hand is doing.

How would you know if you are banned I never refused to pay the fine, He just let us go without explaining why we were there in the first place! Surely you would be given something in writing to explain the reasons why you were banned.
