Water Debt

I would appreciate some advice.
Our developer "elected" a maintenance company for our site before all private owners were given their tapus. There is a split on site of around 40% private owned 60% developer owned property. The maintenance company inherited (from the developer) a large water debt with the Belediye which, in the year or so since they have been managing the site, has grown to around 40,000tl. The maintenance company say they cannot discharge this debt as the developer has not paid the site maintenance fees for the properties they still own. The council have now cut off the water and will not reconnect until the debt is settled. This is of course of no particular inconvenience to the developer trying to sell property but is a problem for the rest of the private owners who have paid their dues for the year and want to use their property....
I know what should happen in theory under the Condo Law - notices for non payment should be served, bailiffs instructed, forced selling of property etc but for some reason the maintenance company has failed (despite substantial encouragement from private owners) to do any of these things.
Does anyone know of a situation where the maintenance company have successfully pursued these legal channels to recover debt or is this just one of those things which sounds good in theory but that just does not work in practice?
Any views gratefully received!

Given the balance of properties owned I assume you are not at first base in voting in an owners committee and operating under condominium law.

If as you say, the maintenance company was appointed by the developer then they are effectively just contractors working for the developer, so donít expect any help from them.

This is all your developers problem and you need a lawyer to sort him out.

Irrespective of the number of properties owned by the developer, he is still only entitled to a fixed percentage of the votes. Off the top of my head, it is not a large percentage.
The other owner`s are perfectly entitled to call a meeting, vote out the maintenance company, and instruct a solicitor to go after the developer.
Even the threat of following this course of action, might lead to something positive. e.g. a notarised letter, in Turkish, to the company and the developer. They are well aware of the laws, and this would not be expensive.
