help - site maintenance and charges
We own a freehold apartment in Calis in a complex of 20.
We were told that we own everything icluding the bar and pool table etc.
Our maintenance fees for the year cover the cost of two people to run the bar area for us.
It now seems that the builder has rented the bar to a private individual who is now proceeeding to charge our guests for the use of the facilities on offer.
Surely any rental for the bar or charges for use of facilities should come back to us as owners?
We as owners feel ripped off but not knowing the full ins and outs of Turkish law on matters such as this we don't know what our next step should be.
Can anyone point us in the right direction?

Anne the first question is did you all have this in your contracts? Secondly if the bar is on your plot of land and you should all have on your tapu 1/20 arsa paylas or something to that effect then the builder has no rights to rent out anyhthing on the land as if all the apartments are sold then he doesent own any part of it.

Yes our tapu states we own 1/20th and all are sold.
Any ideas what our next step should be?

Have you got contact with the rest of the owners or some of them ? you wıll need to get a letter signed by as many of them as you can and send it to the belediye statıng that no one has permission to rent the bar area and that the builder has done it without your express permission illegally. İf you used an agent contact them and see if they can sort it out for you or at least find out whats going on first. only eight owners so far have seen fit to answer any emails - maybe they don't mind being ripped off  so will take it from there now.
Will contact our agent and see if they can offer us any help with this matter and if not then it's the belediye.

Contact Ali Boz at the Almina appartments he will be happy to advise .He is a local councilman,and very helpful and nice guy.
