Maintenance fees

Hi, out of interest has anyone any advice on dividing maintenance fees on a complex ? , or is the normal way & possibly the fairest & best way just to divide the £ equally between properties ? Itís a site of 50 apartments , communal grounds , legal commitee etc. At the moment we all pay the same but one owner has mentioned dividing it depending on size - I should point out all are v v much the same size though some do have 2 small bedrooms instead of 1 large. This doesnít really effect the amount of ppl using the apartments anyway as the others have sofa beds, where as ones with 2 bedrooms may just be sleeping one per room. Is this a pretty pointless way of dividing fees ??, does seem slightly unfair to me & can see it raising problems

Any difference should be on square meter-age of the property. generally larger properties pay more in maintenance fees.

We have a flat in the UK where the charge is made according to square metre of each flat. It must make it a lot more complicated for the people that issue the bills.

III Ė Participation in the general expenses of the main property
ARTICLE 20.-
(Amended first parag.: 13/4/1983 - 2814/art.9)
Each of the condominium owners are liable to participate the followings unless otherwise is agreed between themselves:
a) Equally to the expenses of door-keeper, central heating operator, gardener and watchman and the advances to be collected for them;
b) The insurance premiums of the main property and the maintenance, protection, amplification and repair expenses of all common premises, in other expenses such as the salary of the manager and in the operating expenses of the common installations and the advance payment for expenses, in proportion to its share of the building plot

First look to see if there are provisions in your "lease" ( I use the expression loosely) or the agreement under which you have ownership.
If there is nothing then your fallback position is that under the law, as posted by jearden.
I am familiar with property management from my past life, not uncommon for the apportionment to be calculated by reference to the area you occupy as a proportion of the whole.
