Maintenance fees

Hi all,

Would anyone be able to tell us at what point of you purchase you were invoiced for maintenance. Appreciate any help on this.

I would have thought that maintenance should be paid at the start of the year but the actual date would be set by the complex committee on our site it is written that it should be paid in January but most people never pay until June which is when they start going out and that is acceptable although much later than June and a small fine of 5% can be imposed,

Although if just purchasing obviously check to see if the maintenance has already been paid.

If you are purchasing a resale then ask when maintenance is paid, if it is earlier in the year than when you purchase it then it should be already paid for that year.

Thanks for replies..

Were in a bit of a complex situation I think.. paid Asem a lot of money years ago and for reasons too long to post we've yet to receive tapu, yet to even have keys or access to apartment (never been to). Got to a point now where tapu about to be sorted and now been told this won't happen until we pay back dated maintenance fees

Seems that each time we almost resolve this Asem put an obstacle in our way .. I know probably best seek legal.advice but trying to avoid yet more costs ...

Maintenance fees are the responsibility of the owner, the owner is whoevers name is on the Tapu. it would appear the Tapu is in Asems name and he is trying to get you to pay his fees. The fees would transfer to you IF you get the Tapu as you would then be the new legal owner and debts transfer with ownership.
Once you pay them you are no further forward as you still wont have a Tapu.

IF you get the Tapu you MUST check for debts against the property before you let it be signed over.

Thank you juco.. I did suspect that would be the case, just going to stand our ground on this so to speak. I think it best to book flights and sort face to face as we have unfortunately going round in circles.

Can I ask are you a Blue view owner ?

Don't forget ASEM also have a UK office but from previous attempts to try and contact them even when attempting to make a purchase was impossible. Sorry but no contact details.

No I am not a blue view owner, I dont own now but when I did I bought blind and sold lucky, one of the fortunate few.

We all have differing opinions on how we would deal with this.
Personally I would not part with another penny.

A solicitor will take your case and most will just milk you of more cash, you may be legally correct and you may win but then the one you take to court will declare bankruptcy and you are back to square one but many pounds lighter. I also believe you have to put cash up front and it will be several Łks. I think it is a % of the value of the property.

As far as the Tapu is concerned IF you were to be happy to pay that (maintenance) to get the Tapu you could argue that once the Tapu is signed over the maintenance fee debts would also come with it and you would then be liable to pay them.

Dont pay any more cash for anything as it stands you do not own the property so anything you pay out is for the current owner, if you have some sort of contract from a solicitor when you `purchased` I will bet it doesn’t stand up in court we all had them and they are efin useless.

I repeat again if it looks like you will get the Tapu check for outstanding debts (water/electricity/loans) against the property before it is signed over!

As far as we we aware the UK side of this company was liquidated last year.. a quick search of companies house confirms this . Claire no longer is a part of Asem but it is still within the family (apparenty).

Our situation is with Blueview, we're keeping an open mind at this post and hoping new owner does right by us and sorts this out. Wish us luck

if it's nothing to do with the ongoing saga on GBC and if you have plenty of time then you may like to take a look here atwaht you may be up against

Do you know how much in total they are asking for?
maybe if it's a reasonable amount and it gets you your Tapu then at least the end justifies the means and as Juco says all/any debt remains with the property. and it may just work out to be the cheapest and quickest option overall.
