Unhappy Delays in getting TAPU

Hi All,
I have physical possession of my off-plan appartment but am still waiting on the deeds for over 1.5yrs now.

I have already paid 2,500 euros to Kazmaz solicitiors in Bodrum to pursue it for me and they seem to be getting nowhere.

I reasoned the delay were due to the recent changes in Turkish laws to allow foreign land ownership but these issues have been resolved some months ago.

The solicitor has since been telling me that due to the developer's death earlier this year, there are outstanding inheritance / succession issues to be settled before the developer's son can finally hand over the TAPU.

My gut instinct is telling me the developer does not have the cash to pay for the tapu or some taxes before the notary can provide him with the tapu's for all appartments on the complex. Does this sound credible?

A handful of buyers who bought directly from the landowner (who owned 4-5 appartments onsite) recieved their TAPU's last year.

I have withheld only 10% of the stage payment balance so I don't have too many bargaining chips left to entice the developer.

If anyone can offer real advice (apart from recommending more expensive solicitors or take a chill pill) like confirming how long it normally takes for a wealthy hotelier / developer family inheritance issue to be settled and what can I do to find out the status?

it took us 3 years from dec 05 its sitting in our solicitors office at the moment waiting to be picked up

Hi ger,
we have the same sollicitor and the same probleme with a difference though: The developer is still alive -god bless him - but the military seem to be all dead !
I'm asked to pay more to get my purchase secured but I won't do it.
So I'm afraid all we have to do is wait and cross our fingers.

thats terrible 1.5 years .we got ours in 6 months as the build finished . sounds to me as though he had some sort of debt on the tapu in the first place . try and go to the tapu office and check it out . though kaz maz should have done that anyway . what a crazy system . imagine buying a home in the uk and not getting the deeds for years .

Try giving panther a pm. He has just done a thread about getiing his habitation cetificate through government pressure? He said he will help anyone who pm's him. He may have some good info for you.

Hi Ger78:

My situation was completely different as I had the tapu.

The solicitor was a waste of money.

As someone said check the tapu office. Sometimes people do have to wait a long time for tapus.

There is the Chamber of Commerce which deals with businesses where you can complain to and there should be a one in your area. Didum has a CAB citizen's advice bureau which has featured in the voices newspaper for this kind of negotiating for purchasers between builders and has been successful in getting a lot of purchasers there tapus. I believe since opening a few months ago.

Since the builder died seems to put a different perspective on issues. It seems to be a waiting game.

I don't know if anyone else can give you anymore advice on this.

I'll chase it up with this new info you have given me :-)

It's hard to put your trust in anything/anyone from Turkey when, what should be a straight forward legal process, cannot be resolved quickly by expensive lawyers.

Ours took 6 months back in 2006,signed in June had tapu in november.

Hi Ger78 and all,
Your title deed procedure is very different from a normal title deed procedure. If you will wait for the inheritors legal position, you wait such a long time because of the cases between them . You or your solicitor should talk to the inheritors and induce them to sign your title deed, if you have your military clearance .
I guess you have the military clearance because 6 months is an enough time period to obtain it normally.
As being a Turkish lawyer, I advise you to deal with all the inheritors to go fast. Otherwise you can wait for the case process years and years.
