Headaches buying property in Turkey

Hi everyone, I have had so many problems buying an apartment in Ortakent for the last 5 years, that I wish I had never gone ahead. I found out that the builder built on military land so I couldnt get the tapu, the solicitor acting for me in the sale kept some of my money and didnt give it all to the builder. I have since got a new solicitor who has taken both the first solicitor and builder to court. Two years later still none the wiser. I have paid for the apartment, legal fees twice and court fees and have got nowhere. Does anyone have any suggestions as to what I can do?

Alayna, welcome to the forum, I wish it could be under happier circumstances, but you have made the right move joining, hopefully highlighting your plight will open up options for you that you may have overlooked.
I myself had issues in the past and one of the most frustrating aspects of my trouble was learning the entire truth, I like you had a solicitor and sadly it done me no good.
I am not desperately familiar with the area of Bodrum but I would like you to have a look at the link I have posted.

In addition to reading this please take time and familiarise yourself with various threads on this forum to assist you in your quest for justice.
Anything you are not familiar with, Ask !! there is always some helpful member with the answers.

Welcome Alayna so sorry you have had such an awfull time of it,not just conned by your builder but also by your Solicitors ,sadly you are not alone and join a long and ever growing list of similar buyers. I hope that you get some sort of justice in your quest for your Tapu. jewel x

Also welcome from me in Istanbul. I bought in a tapu banned ( to foreigners) area so my lawyer has the tapu in his name. People either do that here or form a company. What I'm trying to say, in a long winded way is that as you have paid for the flat, if you find an honest lawyer ( and believe it or not there are some!) then all is not lost and you haven't lost all your money as you can still enjoy the flat which the lawyer holds on trust for you.

Welcome to the forum. so sorry to hear about your problems, sadly there is a very large queue in a similar boat - myself included, i have been battling FOUR court cases since 2008 and it jjust seems to be never ending and fraut with problems. I was always a great believer in justice will prevail but sadly, i am no longer of this opinion as Turkish law and courts are a complete enigma to me!

Welcome to TLF, if the only problem you have left to solve is getting the tapu into your name then you do either have to find someone reliable to put your apartment in their name (would never do this myself!) or form a company which costs you around 3000tl to set up then yearly fees of extortionate amounts.

We originally bought on a ko-op in Ortakent, when we bought we could have it in our own names (no tapu at the time as it was still being built) by the time the complex was finished they had re-zoned the whole area and although on paper at the ko-op we owned the property, legally we could never get the tapu in our name as foreigners. We bit the bullet and formed a company as there are too many complications re having the property in someone elses name. As foreigners we can only set up a Ltd company and there are set rates that accountants charge for this and they are not cheap!

I know you have been through a lot to get this apartment, but can you not sell it and pick somewhere else that you can buy in as a foreigner?

Please note - a foreigner cannot set up a Turkish company any more in order to buy a property in a restricted (including military) zone. That law was changed a couple of years ago.

Sara66 I don't agree with you on this point. I started to form a company but it was going to be too expensive to run so I decided instead to put my tapu on escrow in my lawyer's name. I live in tapu banned Beyoglu so there are quite a few people doing this. I an a lawyer myself and we drafted the escrow agreement together. If you do this you have get your lawyer to make a power of attorney in favour of another person should something happen to him or her.
