This all depends on the land in question.

If the land already has IMAR (Building permission), the Military Clearance procedure is the same via Kadastro & Tapu Office.

If the land is Village Land with no IMAR, a Non Turk Citizen must first establish a company here in Turkey, the land is then purchased through the company and all clearances, including Military, are done through the Valilik.

Dear sir
I have buy a apartment in Fethiye since December 2012 and i try to let the seller gave me the Tapou but he temporize what shall i do now if i have just contract signed from the seller and stamp .
note: I have pay all the apartment amount

My husband and I bought a property in Didim through a local well-established and respected agent and came unstuck as we very stupidly thought the contract we had with them was legally binding. It took 3 years and thousands of pounds having to hire a lawyer and fight through the courts all because we were nave and too trusting. I think the advice you have given is excellent, possibly the most important point being that the contract is notarised.

My advice is don't do it, it is such a risky business, we bought in 2004 and have been trying to get our title deeds since then at a cost now of approx 20K and have just heard the landowners have sold our property with all my furniture in it.

You don't need a solicitor. Make sure you get the money before handing over the TAPU "at the TAPU office", if you don't speak fluent Turkish you will need an interpreter. It is all done at the TAPU office, some Turkish pay cash at the TAPU office be careful on your way to the bank if this is the case.

With regards to buying a resale property!

If buying of another british person and the money is transferred to that person in sterling in the UK, what if any documents/evidence would the buyer need to show at the Tapu office?

Also are copies of a passport or/and passport size photographs required at any stage of the process.

Basically, what paperwork should a person who is 'buying' a property need to show?

You have my sympathies and thanks for posting your dilemma as a caution to others, I would however disagree on one point, the most important point being pay for it in the tapu office when the tapu is being transferred.
