Still even now after nearly 3 years I got "done" last year (and by an English person at that!)

Our washing machine needed a new drum bearing ,so I put a post on facebook , got 2 replies , one from a local bar owner and another from an English woman who is associated with one of those companies who do everything ( clean property, do repairs etc), so rang her up , told her the problem and she sent someone out right away
He was Turkish, he went to the washer, spun the drum, then rang her up
She told me he said the bearing had gone and a new washer was the way to go . I told her the machine was in really good order apart from the bearing and we'd leave it
The next thing, he held his phone up with 60 on it (he wanted 60 lira for a call out charge) I rang her back and told her nobody does a call out charge here , but she was insistent they did charge

I paid up then rang the bar owner (who we know) , he directed me to a shop the locals all use, two guys came out the day after, took it away for 2 days and fixed it

He says

45 gün yasal sürem var.
Fakat bize uygun kiralık ev bulursam daha erken evi size bırakacağım.

We got turkish friend to speak to him and he threatens to stay the full 45 days if pushed to move out.

Very very bad experience. Not sure if this 45 days law applies only in ankara.

Scanned quickly Turkish forums about similar situations. Couple of hits. All in Turkish.

One buyer delayed the possession per request from the seller and put a specific date of possession in the contract. Yet, the seller still did not move out on the agreed to date. Legal advise he got was file a complaint with the "kaymakamlik" for unlawful occupation of property.

Another person chimed in and said, he was in similar situation and "kaymakamlik" was not accepting any applications on this matter. Because he was told that if the seller had vacated the premises then he re-entered is one thing but if he never left the premises, they cant help.

The best advise he received was to send a notarized warning letter(ihtarname) that you will sue for back rent for days he illegally squatting in the house and will ask him to pay for your legal expenses including attorney fees. This might light a fire under him to get out.

Another person had luck when he asked the police (an acquaintance) to go and discuss the matter with the uncooperative seller. That worked. You could go to the police station (karakol) and get some advise, perhaps help.

Failing that wait out your 45 days and chalk it up to experience. Hope that he is sincere about the 45 days,

Good news for you is that your seller's claim of 45 days doesn't appear to be unique to your situation.

In the link enclosed above. The seller is again claiming 45 days to leave. In this case, the buyer checks with the TAPU office about the seller claim of 45 days, the buyer is told no such law. However, the real estate agent backs up seller's claim. Such contradictions are not uncommon. People (official or unofficially) are uninformed about the law.

Legal advice in the link (last post) once the official registery has taken place, the seller has to vacate, if not


a) file a complaint with the "kaymakamlik"
b) additionally you can file a lawsuit.

It appears the Law does not provide 45 days to vacate.

All this 45 days stuff sounds like bull**** to me, however I would have to ask our lawyer about that, I would think as mentioned try having a word with the police first if not find a recommended lawyer and see what they say, probably a threat of legal proceedings an costs would be enough to shift him otherwise a court order. I would forget about the furniture.
