Transfer fees when buying...

We are about to complete an apartment sale in ankara Turkey and would like to clarify few things handing over the money.

94xxx nolu islemin 742.25TL. Doner Sermaye ve 2000TL. Tapu Harci odemesini 18331794xxxx no ile Ak/Finans/Garanti/Halk/Is/KuveytTurk/Vakif/Ziraat Bankalarina yapabilirsiniz B030

I see fee of 2000TL is very low compared to 8800tl that was paid by another friend for an apartment bought at 260k but tapu had 220k written. Does anyone reason for such a difference in fees?

This is zero building with with some flats not been numbered yet and some don't have radiators. Some flats are already occupied so we don't know whether this is completed project or not.

Price agreed is 265k and there is no address on receipt due to numbers not allocated to some flats . How do we make sure they sell us what we have been shown.

At that price I would defo want to be 100% sure you get what you chose .In fact I don't think I would complete the deal without cast iron guarantee.

Had to go to Tapu office last year to change paperwork, as our villa was under a different number then it should have been. Villa next to mine was selling so needed Tapu sorted out.
Cost about 4000 lira.

good advice from evo80, take it! I can't see how you can get a tapu without a specific address.

I think i found the answer on this forum.

I need to explain the terms first to be understood properly, I guess.

First, you must know that "kat irtifakı" is the name of a joint unity where the owners have shares on a property. A building is constructed on a land(arsa) and kat irtifaki means to be that you are having a portion of it, but not an independent apartment. The transformation of tapu deeds(from kat irtifaki to kat mulkiyeti) is required to be done by the government because of this. Otherwise, there seems to be only one property of many owners(although each of them has one property) with shares, and this causese tax loss.

While holding a kat irtifaki deed of a property, you are not deemed to have an apartment, but share of a property(1/16 or 1/22 for instance). You have to apply to the land registry office for changing the type/description of your tapu with this reason. Some of the members here might have heard about the type changing before, it's called cins degisikligi/tashihi in Turkish.

The 15 per thousand of tax rate is to be imposed on changing the types of properties and it's calculated out of the current value of the new type of the property(house, workplace and etc..)

In conclusion, the amount of money that you payed while buying the tapu of kat irtifaki was calculated out of the value of that share, but not an independent apartment. The change of the type/description will be compulsory for transforming the tapu record from kat irtifaki to kat mulkiyeti, and you'll have to pay this 15 per thousand tax that will be calculated out of the value of your properties.
