Oruc invade Iztuzu Beach illegally - again!

Dalyan Çevre Geliştirme Turizm İnşaat Emlak ve Otel A.Ş. (DALCEV)’s claim to have the management rights over Dalyan’s Iztuzu Beach and their attempt to put their personal bellongings in one of the huts in the beach has arouse a new argument.

Tuesday night, a group of people whom claim to be “The Men of DALCEV” (The organisation of Oruc Travel) came to Iztuzu Beach and water to put their own belongings in one of the huts and wanted to remove belongings of the Mugla University staff whom are managing the beach currently. The management of the Iztuzu Beach has reported the issue to mayor’s office and to police and pressed charges against the DALCEV, stating that the management right of the Iztuzu Beach Special Environment Protection Area was granted to Mugla Sitka Kocman University by the Ministry.

On the contrary, DALCEV claims that the management rights of the huts on channel side where people reach by boats were granted to them. President of DALCEV, Ramazan Oruc, said that “Management rights of boat side of the beach were granted to our company on December 29th 2014. As the tourism season started, we just came to our own facilities to take it over. There is no court order against the original right that was granted to us. There was an attempt to cancel the agreement that was made between us and the ministry however courts of Mugla has overruled against this attempt. Therefore we are using our right that was granted to us.”

Ortaca District Governor Mr. Fatih Urkmezer said that they received a complain from the Mugla University against the DALCEV trespassing and forcefully trying to occupy the facilities at Iztuzu Beach. He said that all necessary reporting has been done to authorities regarding the complaint and Gendarme will be controlling the facilities to keep further attempts away and will report to authorities otherwise.

What had happened in 2014 was, the management rights were given to DALCEV by the MUCEV (Mugla Environment Protection Agency) but Ortaca Municipality opposed to this decision and went to court because the bid organised for the rights of the Iztuzu Beach was not lawful. In 2014 MUCEV opened a bid for the management rights of the Iztuzu Beach but only DALCEV was informed from the bid and overnight the management rights were given to DALCEV who was the only bidder. DALCEV and its president Ramazan Oruc is known to have close relationships with ruling political party and the government and they have used their personal relationships to make this deal. however, upon Ortaca Municipalities opposition and people’s demonstrations, court has overruled this decision and Environment and City Planning Ministry had granted the management rights of the Iztuzu beach to Mugla Sitka coachman University.

The attempts of DALCEV is considered a desperate move because they had plans of turning the beach into a money making business rather than keeping it a natural environment as it is.

We will keep you updated as more information is available regarding the court case filed up against the DALCEV and their “men”

A company has “forcefully” returned to the idyllic İztuzu beach on Turkey’s Mediterranean coast, renowned as a safe haven for loggerhead turtles, and claimed the right to operate the facilities at the seaside, a year after the Environment Ministry cancelled a controversial tender to privatize the facilities following protests. Muğla University, which was entrusted with the protection of the beach in the western province, made a report of the incident and filed a complaint with the district governor’s office.

Facilities at the idyllic beach were controversially privatized despite strong opposition from local residents in June 2014 but operations were later suspended by a court order over a lawsuit opened by activists.

Hours after the first stay of execution order was lifted on Dec. 28, 2014, officials from DALÇEV, the local company that won the tender with a bid of 8 million Turkish Liras, entered the beach with construction machines around midnight, prompting a spontaneous rally.

In the meantime, a local court also ruled on Jan. 6, 2015, to suspend the deal in a separate lawsuit between the governor’s office and the municipality, further complicating the judicial battle.

The final move was made by Turkey’s Environment and Urban Planning Ministry, which signed a protocol with Muğla Sıtkı Koçman University and entrusted the institution with the operation of the beach.

Company officials from DALÇEV, however, reportedly entered the beach on May 10 and attempted to forcefully take over the operation of its facilities, allegedly removing locks and emptying the facilities.

“They [DALÇEV] are presenting a protocol they signed with MUÇEV [the Muğla Environment Protection Foundation operating under the governor’s office of Muğla] in 2014. The document has no legal validity,” said members of the university’s commercial enterprise board, adding their security staff did not intervene against DALÇEV officials to avoid making a scene.

“We made a report of the incident and filed a complaint with the district governor’s office of Ortaca [where İztuzu is located],” they added, according to reports by Turkey’s state-run Anadolu Agency.

The district governor of Ortaca, Fatih Ürkmezer, also made a statement to reporters and said the gendarmerie was set to make an investigation and related departments would proceed accordingly.

Meanwhile, DALÇEV chair Ramazan Oruç claimed they were entitled to operate İztuzu following the June 2014 tender, arguing the beach’s appropriation to Muğla University was solely for protection purposes.

“There was an attempt to cancel the protocol but the local court in Muğla barred that attempt. Hence, we are practicing our right. The university is here for scientific purposes, without any commercial purposes,” Oruç alleged, adding they had begun preparations to run the facilities over the summer.

DALÇEV’s attorney, Musa Müfit Elitaş, also reiterated Oruç’s point, claiming it is “legal” for DALÇEV to operate İztuzu.

“We base our argument on a delivery record dated Dec. 29, 2014. There are no records or court decisions against this delivery record. Hence it is legal for DALÇEV to be here,” Elitaş said.

On the other hand, a member of the university’s commercial enterprise board, Mehmet Ayhan, said the protocol between the Environment Ministry and Muğla University rendered previous delivery records obsolete.

“This matter cannot be resolved with bullying. We will not engage in any actions with them, we initiated legal proceedings,” he stated, according to reports by Doğan News Agency.

Oruç is a former ruling Justice and Development Party (AKP) candidate for the municipality of Ortaca while lawyer Elitaş is a member of the AKP’s district administration.

Former Environment AKP Minister İdris Güllüce had announced his decision to cancel the privatization tender on his official Twitter account in January 2015, stating there would be “no commercial activity, sunbed or umbrella on İztuzu beach.”


“We’ve gathered with academicians and journalists. We are going to entrust the caretta carettas [loggerhead sea turtles] to Muğla University. We will sign the necessary protocol,” he added.

This must be stopped! Oruc are always just making money, have no regard for nature or the turtles and it is the turtles beach. Surely if everyone stands together this can be stopped again, as it was before? It must remain principally the turtles beach and we the public are guests there. The future, if Oruc stays, will be jet skis, jetties, power boats etc bringing noise and a lot of danger to the turtles. We must make sure this does not happen.

Update!
The Ministry of Environment has ordered Oruc OFF the beach by police force IMMEDIATELY!! They have stated that Oruc 's (under the guise of Dalcev) invasion of the beach on 11/05/2016 is illegal and they had to be removed.
Of course the lying low-life are still insisting they were granted rights to the beach when Tayyip Erdogan was prime minister and they will follow their rights in court!!!
So thanks to Berna Babaoglu and others who have been instrumental in having the beach returned to Mugla Universtiy.
Sadly I don't think we'll have seen the last of the disreputable Oruc family - isn't it about time they were drummed out of Dalyan?

Court orders evacuation of İztuzu Beach, occupying company set to appeal


A local court has ruled for the evacuation of İztuzu Beach on Turkey’s Mediterranean coast – a safe haven for loggerhead turtles known as caretta carettas – by a local company claiming to hold an exclusive right to operate the beach’s facilities. The ruling came days after a similar demand by the Environment Ministry, while the company has insisted on staying, suggesting it would appeal the decision.

DALÇEV, the local company which claimed entitlement to operate the beach after it won a controversial tender organized by the Muğla Governor’s Office to privatize the beach, forcefully returned to the beach on May 10, despite a court order suspending the deal a year ago.

The court’s ruling was followed by a three-year protocol between the Environment Ministry and Muğla Sıtkı Koçman University signed on May 23, 2015, entrusting the university with operating the beach’s facilities, protecting it from environmental damage and conducting studies on its biological diversity.

Officials from DALÇEV, however, controversially returned to the beach on May 10 and forcefully took over some of the facilities. They later transported two generators and construction equipment to the beach, despite a letter from the ministry addressed to the Muğla Governor’s Office demanding an evacuation of the beach, with help from law enforcement officers, if necessary.

A second decision, this time by a Muğla court on a case opened by DALÇEV to render the protocol between the ministry and Muğla University ineffective, also ruled against the local company, saying the ministry was legally entitled to decide who would operate the facilities of İztuzu Beach, as the beach was under the supervision of the ministry.

“There are no contradictions of law in the case in question,” the court ruled.

DALÇEV, however, has continued to insist the university “occupies” some of the beach facilities, claiming the protocol with the ministry was purely scientific and did not grant a right to operate the beach. The company said they were considering appealing the court’s ruling.

İztuzu Beach Rescue Platforms Spokesperson Berna Babaoğlu Ulutaş warned that DALÇEV officers were committing a crime by not evacuating the beach despite a court ruling.

Another member of the same platform, Meral Metin, underlined the company was currently an “occupant” of the beach, and criticized local state authorities for failing to take the necessary action despite a demand from the ministry to do so.

Metin questioned how the company managed to transport generators and construction equipment to the beach by using a ferry that was only authorized to carry passengers, especially at a sensitive time when the caretta carettas were laying their eggs.

“We expect an explanation from our governor and district governor. Everything is illegal but somehow authorities do not initiate legal action against the company. We are curious why this is the case and we call on our deputies to take action,” Metin added.

I am not saying that's true just what I heard last week.

If true I am a dissapointed .

I read and heard this too like 1-2 years ago. Seems like two Brits are main shareholders of Dalçev:

Taken by surprise, the Dalyan community and local council were informed on 11 June 2014 that the Turkish Ministry of Environment and Urbanisation and the Muğla Governorship had decided to privatise award winning Iztuzu (Turtle) Beach. The lucky winner of a "telephone tender" was DALÇEV, established only 2 days before. The majority shareholders Malcolm Robin Gray and Charles Bentley, partners in UK-registered Dalyan Villa Owners Ltd, are British businessmen. The three Turkish shareholders are partners in Dalyan-based Oruç Construction and Travel.
