Info on solicitors please

We are thinking of going down the legal route regarding our build and wonder if anyone can tell us what to look for and what to avoid when chosing a Turkish solicitor. We have heard they charge a percentage of the total house costs, does anyone know what percentage this is.

The builder is delaying the build, demanding more money - we have paid up front (I know I know), the house is not being maintained and is damp, smelly with dark mould growing up the walls and the outside is cracking. He has given us several completion dates and uses emotional blackmail to get more money. We are also having Tapu problems. We were promised the build would take 45 days to complete and that was over 19 months ago and its still unfit to live in.

Hi Nanamo
from your opening of the thread i assume you started the buying process without a solicitor to begin with (i am not going to comment i think you know by now thats wrong), i would therefore presume that your builder also knows or at least assumes you dont already have one in place otherwise by now you may have mentioned it to him.
therefore without further delay get a solicitor and make darn sure he knows you have one, and dont give the guy a penny more untill such time as your happy with progress, i am sorry that i cant recommend one to you but someone will.
Just to help you for further reference if you spend some time using the search box you can put in anything and it will bring up all references made before to that subject on the forum, it will certainly have a host of info regarding what your next steps should be and how to go about it, its just a matter of getting the right key words.

Hello

The Turkish Costs Rules under Turkish Law lay down a sliding scale for calculating the cost of legal work. Without recourse to the Courts, the scale is 2%-6% of the value of the claim (e.g. the claim in your case is the property purchase price). The precise percentage applicable to you will depend on the complexity of the matter in question and the amount of work involved - since as you can appreciate, this can vary from one property to another.

If the matter needs redress via the Court processes, the Turkish Costs Rules state that legal fees are 12% of the value of the claim - credit of course being given for any fees paid under the non-Court process percentage.

hi there

I am a British lady working as an Assistant to Solicitor Birgul Oner in Kusadasi. Most Solicitors charge for court cases 10% of the amount in question. In addition there are usually some court costs which can be claimed back from the other party provided you win your case. Please note you cannot claim your actual solicitors costs only court costs. This is probably why Juco - it would be of course complex and vary! Is there such a normal case that cost anyone between 2-6% . If so I wouldn't mind hearing about it!
