Advice Please
Hi,
Our builder has told us he will turn off our electricity and water if we do not pay our maintenance. We have disputed the maintenance fee as we do not have contract etc. They are charging €130/month for apartment. I told him I will pay half as I believe this is enough. He has refused this and said if I do not pay full amount he will cut off water and electricity. I have always paid these charges to him (without receiving bill). I have my Tapu since last year. Can someone please advise if he is legally entitled to do this.

Do you have your own electricity and water meters? It is illegal for anyone to disconnect these unless from the respective agency.

Some members here a simply mad, 150 Euro a month is outrageous and you should never have agreed to it. Depending on the number of apartments and what is included in the maintenance, I'm going to guess that between 20 and 30 should be enough.

Does your apartment block have a management committee? Have you spoken to other owners and compared bills?

I'm sorry to hear that you are experiencing some problems with your builder.
To give you more useful information can you please answer the questions below?
1- Did the builder charge you for water and electric registration?
2- Does your property have habitation license?
3- Did you go to the council to register the water on your name?
4- Did you go to TEDAS (electric company) to register electric on your name?
5- Does your property have a seperate water and electric meter?
6- Are there any number plates above the meters?
I will try to help you if you could answer the questions.

The setup on the development is builder has not sold all units so he is supplying electricity and water. Our meter is on his generator.
1. Builder has not charged us for water and electric registration
2. It is my understanding I cannot get habitation license until we have our own proper meter.
3. Have not gone to council yet as water is delivered by lorry as there is no water mains.
4. Builder has told us we cannot register electricty until site complete.
5. our electric meter is on his generator. No water meter that we are aware of.
6. Not sure if there are number plates.
We have paid all electricity and water charges builder has given us. Although he charged us €90 for 1 week electricity last year.
Any advice on what to do would be grateful. Although I am in dispute over maintenance charges I feel their threatening manner is unacceptable and can't believe this behaviour would be legal.
We did not originally agree to this charge as we were told maintenance would cost £25 per month which is acceptable. They refuse to discuss this with us and say we have to pay up. Although we do love the apartment I feel so disheartened over their attitude.

The same thing is happening at Arinna complex in Gundogan, although on a much bigger scale. Developer/ landowner/builder demanding the sum of £1900 to finish the site even though everyone has paid their final payments over 12 months ago (under threats of repossessions). If we dont pay they will cut off water and electricity!!

any advice on my situation would be appreciated. I just want to know if builder is within his legal rights to switch off power. If not, how do I go about letting him know this.
