new rental laws

Every year my friend stays in our apartment over the school holidays, she cleans it and does whats necessary as we can not go anymore my partner has parkinsons and cannot climb steps he is totally wheelchair bound now.

Ive been told that if she is found in the apartment there is a possibility of a fine to me because of some new law, can someone give me some advice please. I have at times lent the apartment out to other neighbours family etc when they are visiting for a very small charge so I do need advice on this also

This would not apply if she had a long term lease, but then you would have to declare a rent and it would be taxable.

It looks as though from the advice both have given that friends and family can not visit parents properties anymore thats terrible, I didnt realise it was to do with tax I thought it was only informing who was in the property. I would imagine it would be impossible for the jandarma to knock on everyones door to check on this or how else could they check on properties ?

No-one is clear what it is to do with, but I think that they would rely on informants but could easily check if someone was living there by checking utility consumption.

Background.
According to change in the law on 22/11/2016 /effective 21/01/2017 .Each owner who rents
his/her property is required to report the tenants full name, turkish identity number or foreign
passport number to the local gendarme or police authorities.
Those not aligned to the general law enforcement systems could be handed fines of over 10,000
TRY by the heads of the municipal administrations, while a fine of 5,000 TRY will be administered
to those who do not send relevant data instantly or record untrue records. Fines have to be paid
within one month or licenses will be cancelled.
The boundaries of where a guest is a family/friend lie is not 100% clear unfortunately and info as
to whom registrations apply has not been officially written down but according to Bodrum area
officials information supplied we have taken the following stance to advise our homeowners:
 If you come as homeowner with immediate family,never rent out your property then you do
not need to make any registration or inform anyone at all
 If you come as homeowner with wider family staying while you are there, but never rent out
your property for payment then this is also ok.
 If you have close friends without your own presence, staying in the property, no monetary
payment involved, then it has been suggested that the authorities would like to have them
registered but this part is not 100% clear. (We suspect it would only be investigated if there
was a complaint made or every week you had ‘close friends’ staying and you were not there)
 Therefore, our stance is that if you can prove a close family connection and only you as the
owner and these close family guests come to stay in the property and you do not receive
monetary compensation then it is unlikely that you will get ‘caught out’, however if these are
just friends then it may be advisable to make the registration.
 If your property is advertised AT ALL for rental on any site be it turkish or foreign, regardless
of the fact that you may not have any bookings to date, then we recommend in this instance
that you must register.
 If you receive any payment/compensation at all from a guest in your property be it in Turkey
or abroad then we also recommend that you should register all guests.
 If you have a mix of family and friends and rental guests then you MUST register everyone,
SMILE have been working closely with TURSAB (the turkish travel agents authority) are on the official
committee, have attended all meetings with local mayors, gendarme and police chiefs concerning
these issues.
To put your mind at rest, for those owners that are not part of our SMILE Property Management or
Rental Guests Services programs and do not require this, we can still fulfill all the necessary legal
requirements on your behalf. We are offering our rental homeowners the service of:
- Helping to register (Legalise) your holiday home in Turkey for short term rentals according to
new legislation no: 678 amendment to common law 1774
- working with our program, you will take advantage of shared costs with other clients,

In the UK if we rent properties we do have declare for Tax purpose but we have to be renting up to a certain amount before we pay tax is there an amount in which no tax is paid for renting in Turkey ?
