legal question

Hi all,

I am new to this forum although have owned an apartment in Side for the last 10 years.

Can anyone help with my query, is it a mandatory requirement for cctv to be installed on a complex?

We purchased our apartment from new and until June this year, the builder, Mecitoglu acted as our site maintenance manager. We are now with a new company who have stated that cctv is a mandatory requirement.

Can anyone help please?

Its a very good idea imo and if your committee agreed to have it installed then majority rules I would say.

Good Morning,

Lotus Management took the contracts for Site Management of 19 Mecitoğlu sites as from July of this year. Reading between the lines of your post, I feel that your place is most likely on one of the Side Hill Sites.

There is no law that makes it compulsory for CCTV to be installed on any development but you will find that many of today's 'New' developments include CCTV in the initial plans and are part & parcel of the finished site.

Every Site has an annual meeting for the owners to get together, discuss maintenance fees, work done over the last year and any work or improvements to be carried out in the year to come.

If there was a Quorum at your last Site Meeting and an overall vote carried to have CCTV installed, then, generally speaking, "so be it." This is the idea of the annual meetings so that the wishes of the majority of owners can be carried out and of course all improvements are either covered by an increase in Site Maintenance, or by a one-off payment by each homeowner on the Site.

I hope this helps a little.
I don't think anyone is out to force owners into having systems that they don't want and a CCTV system can be very beneficial to the owners on some of these larger Sites as your Security People can not be everywhere at any one time.

On our site in Bodrum we failed a Jandarma inspection as we did not have cctv of the entrance and exit.

Perhaps Bodrum has it's own byelaws. We , although a very small site have a dolmus route run through and this needed to be observed by cctv.

We were on a site in Gumusluk,which wasn't on a dolmus route,and there was talk about 8 years ago of CCTV cams having to be installed on the order of the police/gendarma.I don't know what the outcome was but at the time I felt it was being seen as a nice little earner by our maintainance company,who had a knack of coming up with nice little earners.

Why oh why are large site plagued by management companies who who believe the owners are h(m)oney pots rather than accepting that they work for the owners and do there bidding and not the other way round; and yes its a rhetorical question.
Its sounds to me like a way for the maintenance company, who presumably have been formally appointed and not been passed onto by the builder, to make money as presumably their current charge includes for providing security and by getting the owners to pay for CCTV will be able to reduce his security staff.

Presumably the cost of security staff is ultimately paid by the house owners through the monthly Aidat, so if CCTV can reduce the security staffing costs it may prove to be a good thing.

Sounds more like what they are saying is for them to take over the maintenance then CCTV would be a mandatory requirement, otherwise they do not want to take it over.

This is obviously all swings-and-roundabouts where maybe if installed could or would the costs work any cheaper, obviously in this day and age not forgetting the on-going security factor.

To put you a little more in the picture.
Mecitoğlu are one of the well established developers in this area and they built this Site some 10 or 11 years ago. Lotus have had these 19 Sites passed onto them for management so that Mecitoğlu can concentrate on further development.
Lotus are not saying they won't manage this particular Site if CCTV is not installed. A majority vote was taken for CCTV instalation at the last AGM.
