maintenance payments
Dont know if anyone can give me some advice.....let me tell you the story... I had my offer on the property I bought accepted in August 2004, but the contracts werent completed until April this year. My tapu states that the property was mine from April this year also. When I went to register with my complex management in September, they said that there were outstanding payments that must be paid before I could register. Apparently the previous owner hadnt paid since 2003 and I was liable for a bill of approx £1000!!! Anyways the previous owner was contacted and he could provide proof that he had paid, the complex then said that they had made a mistake (but no apology!) They then said I was still liable for payments from the day that I had the offer accepted ie August, even though the house wasnt mine until the April! And because they charged interest on late payments, I then had to fork out over £1100 as they threatened me with repossession! Can anyone tell me whether 1) I was liable for payments from August 2) whether I should have paid interest on late payments? I mean obviously the complex are trying to con me, or so it seems, and not one of them speaks a word of English which is really frustrating. Has anybody else had these problems? I am on the Gumsan 1 complex in Gumusluk.
cheers
Sally

Re: maintenance payments
Sally, sorry to hear you are having a rough time with your purchase.
If you had a purchase contract drawn up by a solicitor it is common to include the wording absolving you from all previous sitesi debts on the property.
If you dont have a purchase contract or never used a solicitor this highlights exactly where things can go wrong. In this instance you would be very wise to use the services of a legal representative to act on your behalf.
If you need a good english speaking lawyer in Turkey, please send me a private mail and I will forward you his details.
Merv!

Re: maintenance payments
I would get it translated. If possible you need to pin down the breakdown of the maintenance fees - responsibility/costs for: caretaker (including list of duties), caretaker insurance, communal water and electricity, swimming pool maintenance, gardening (communal and private), sewage, complex insurance, accountants and management company fees, full details of management company. When we bought we did not get any of this which has caused a real headache in sorting out management and maintenance problems. Good luck.
