Re-applying for Tapu
Has anybody had to re-apply for their Tapu?
It is something I will attempt to do in Feb, when I return to the Marmaris area, after waiting 2 1\2 years & was wondering how straightforward the process is.
Do you present your copy of the paperwork from the Notare & they send it off or is it more complicated.
Any experiences would be appreciated.

As I understand it You'll need more photo's and a photocopy of your passport. Also, an interpreter. It's done at your local deeds office.

Re: Re-applying for Tapu
Hi
We had to reapply for our tapu in August in Antalya (after a load of people at the tapu office were arrested for corruption, one of which had dealt with our application and so had to be stopped).
We got a restricted poa signed at the notary office and got the lawyer to do it and the process began again ! We also were able to use the same paperwork as before.
Crossing our fingers we will have military permission by the time we return in April !!
Good luck with it

Re: Re-applying for Tapu
We have just been told our tapu is through, now coming up on 3 years !! We chased this up in May last year with our solicitor in Bodrum and it was quite clear they had forgot to put the papers through or messed up in some way. They didn't admit this, but even though we couldn't follow the turkish it was clear from their body language something had gone wrong. Our manager went to the local offices and could find no record of the papers having been submitted. Our solicitor tried to blame the sellers solicitor, but this didn't wash with us. We knew exactly who was at fault. Needless to say, once we get over again in May to get the paperwork done and dusted we won't darken this particular solicitors door again!

Re: Re-applying for Tapu
Chriss,
2 1/2 years may seem a long time but as g&t say others have waited longer!!
A possible explanation for mine is that I bought in Aug 05, a week into the period that foreigners couldn't buy coz of the new law that had to be passed. Maybe filed away never to see the light of day again!!
When asking the Estate Agents, by e-mail & in person as I have many times, I find the personnel keep changing (4 times in last 2 yrs). No one has made notes so have to explain & go over everything again, then they change again etc. Also ,they close Oct - May so no contact which is why I will now deal with it myself hence my original question.
G & T,
Looks like you could be getting some good news. Good luck.

G&T, this news must have lifted your spirits just a little. Bet there will be some celebrating in your house when you finally get the elusive document.
One question: Have you any idea what date will be on your Tapu when you do receive it? The reason I ask is that if it were backdated to the time you bought the house you would only have to wait another 1 and a half years to be exempt from CGT should you decide to sell it on, but if the Tapu contains a current date you will be liable for CGT for the next five years. Very unfair on you if it's a current date.
