Paul, I understood the Tapu situation had been resolved.

Are you sure of that? Have all the formalities been completed?

Simon: Wherever, and whatever you buy, make sure the Tapu has a cross in the Kat Mulkiyeti box. Good luck with your search.......hope you find what you're looking for.

I was there last week and my agent assured me that the law had been passed that week and that the suspension will end once the ruling has been published in the official gazette, which is likely to be in the next few weeks. I'm sure I've read it in the Turkish online newspapers since I've been back as well.

This is the current situation:

PURCHASE OF PROPERTY IN TURKEY

UPDATED FLASH MESSAGE – 16.04.2008

The sale of property to foreigners in Turkey has been temporarily suspended, due to a ruling by the constitutional court to review the law that was ratified on 7 January 2006 (see below para).

The concerned Turkish authorities have confirmed the review is complete, but awaits signature from all Members of the Parliament. WE ARE ADVICED THAT THE MATTER WILL BE RESOLVED SOON. For further information please contact the Turkish General Directorate Office for Land Registry.

In real terms foreigners can only own up to a maximum of 2.5 hectares (25,000 m2) of land and property. Upon application the Council of Ministers may use its discretion to increase this threshold to a maximum of 30 hectares (300,000m2) providing this figure does not exceed a total of 0.5% of the land area of the province in question.

Foreign nationals and foreign commercial companies are not allowed to buy property in the strategic military and security zones of Turkey.

Please note that to purchase real estate/land in Turkey, conditions of reciprocity, complying with legal restrictions apply. In implementation of the reciprocity principles, it is essential that real estate acquisition rights given by a foreign country to its own citizens and to commercial companies established in foreign countries, according to the laws of these countries are also given to the citizens and commercial companies of the Republic of Turkey. As detailed in the Turkish Embassy website, the United Kingdom and the Republic of Turkey have full reciprocity regarding real estate acquisition.

Reading this as a Brit, I would understand it to mean I cannot buy property at the moment but if you substitute the word "sale" with the word "TAPU" it makes it all a lot clearer!

Technically, completion, i.e. "the sale" is on reciept of TAPU and its this transfer of TAPU/title deeds in your name that is suspended.

As we foreigners dont get our TAPU's on the same day as contract, we have not technically bought until we get out TAPU's and as you all know this has taken some people years!

Its the same situation, just under a different heading - It's "Temporarily Suspended", not cancelled.

Kym,

Thanks for that information. I don't think anyone on this thread suggested that it had been cancelled - just that it had been suspended. How long does it normally take for the document to be signed by the MPs, published and enforced?

We have a lovley 3 bed villa close to Belek , Antalya airport only 20/25 mins away and now this area has 14 first class golf courses all within 15 mins of the villa, please email for more info.

Hi Simon, before you even think about buying, decide where you want to live, secondly set yourself an upper target price and stick to it. Anything else is small fry.
Remember though, at this moment in time it's a buyers market, take your time and choose wisely.

I have a 3 bedroom house in Mavisehir which I'm currently letting out for holidays Sedef Koy, which is only 5 mins walk to the open air market and restaurants. If you need more details just ask. Karen
