My understanding is YES this would be the case for some things but the legislation appears to force you to run it as a business therefore you need to take on board accountants etc. as the tax office wont accept self assessment for the running of a business.

No, that's not the case unfortunately, you could do it 2 ways previously, one way being a profit and loss account and a self declaration, the other being a fixed allowance account where by you didnt have to produce books and were given a fixed allowance from memory it was 3900 TL each, I have posted the government tax calculator on here a few times but the allowance was increased annually.

But that was personal taxation, this move is business and will attract all the beady eyes of government departments and penalties for non compliance, they love that, ask any bar or shop owner.

Source Voices:

There has been much speculation on Facebook and elsewhere about the rental law and who it affects, etc. So Voices put these facts together as described by one of the management companies:

Register: The property being rented has to be registered with a limited company which has the Gayrimenkul (real estate) license and is Chamber of Commerce registered;

Tapu holder: If the TAPU holder is not present when the property is being rented on a short-term basis, the property MUST be registered;

Long-term: If the property is being rented long-term (monthly) and the owners are registered with the Nufus office, then that is ok;

Family, friends: Even if you are not taking any money from family and friends to stay on a short-term basis, you should still legally register the property

Passwords: Individual owners CANNOT simply download the software for their property. Passwords will only be given out by the police once the property is registered.

Only in Turkey: The software system can only be operated within Turkey’s borders and the users have to have a static IP address. Foreign owners living in their home countries with second homes in Turkey, and renting them out on a short-term basis, NEED to register their Turkish properties.

Free: The software system is free to download once the property is fully registered. So it may pay to use a rental manager in Turkey to shoulder the admin burden.

Fines: Failure to register the property is a 10,000TL fine. Failure to register people staying on a short-term basis is 5,000TL a day. Even if no-one stays at the property, a zero has to be entered on the system to reflect that.

This is old news,the new rules are already in,not 2018. A British apartment owner in Calis Beach rented out for two weeks the police found out and because he had not registered,was fined 20,000 Lira.

This is new news, that that you refer to is old news, its no longer just about registration its about setting it up as a commercial business along with all the costs and regulations that brings, I suspect it is to bring parity with the indigenous businesses and the government are not happy with Yabancis taking their profits off shore, I think it will backfire myself.

I haven't heard about this but will make further enquiries to see if its true, my feeling is that's its a possibility that the Kalkan account is just trying to make more business for himself....

This law came in, in November 2016, a million people have been fined in Istanbul already. The Fethiye Times had an article about it 6 months ago, a breakdown of the costs involved,setting up your own company,accountants cost,cleaning costs,tax,vat etc. How to register and the costs and also a very long reply from the chief of the Jandarma who has to policy it.Also,that they would be sending officers around the holiday complexes to check up and looking at owners direct and other rental companies even TripAdvisor reviews. But most importantly they will be relying on the Turkish citizens to report the foreign owners.

This is a link from the November 2017 Fetihye times to another publication, stating it is likely to start on 1st January 2018, so if you live in the UK looks like a tricky one to set up.
