hi all royal blue owners

we are flying out on 4 july staying in altinkum while we are there we hope to go hsm office ,to the site and also to see ekrem so if anybody has got any questions they want us to ask about anything we will try and get some answers we hope to be taking laptop with us we are also hoping to meet up with pam & bob who have been out there for a week so they might already have some of the answers.

Can confirm we have received an e-mail from Ekrem this afternoon stating that we should pay 85% and 1.2% for some form of guarantee. I have requested that they give us excat figures as it is not clear on what figure we should calculate the 1.2%. Not too sure why we should have to pay this extra charge either due to it being their fault the property could not complete.

With regard to the villas, I can only apologise to Chris H if you think I was being selfish. I was not aware that ANYBODY had purchased a villa as it was my understanding from our initial visit there that although they were on the brochure they did not receive planning and therefore were not for sale. I certainly did not know your parents, or anyone else for that matter, had purchased one. I wouldn't like to see anybody out of pocket at any stage in their life.

We have also received the very same email and it seems that rather that withholding payment we are now paying for delays. It seems ludicrous. Who will get the money for the 1.2%. I simply do not understand. I much prefered the offer we had from HSM. Why has it changed so much. We must ensure other solicitors comment on this. I will talk with Prime if I can. Speak soon.

We have received the same email and I can pretty much echo Sezza's thoughts on this!

Have requested some further info and clarification from Esarilaw. And also whether placing a charge on the property (which is provided as part of their service) should suffice (Perhaps this is the same as a Lien but then why would HSM be doing it?).

What I think is a bit odd is that HSM need to approve the Lien.

I wonder why all clients don't have this protection. I think its a bit odd charging you for a lien now that theres a delay rather than from the very beginning.

I think if this had been offered at the beginning I would not hestitate to snap it up for the 1.2% of the price of the property.

I too have asked Ekrem for more detail.

For lien read Ipotek.

The position you're in is typical of Turkey. The developer is running late and misses his contract dates but still wants your money. In return for your money he offers a partial guarentee by way of an Ipotek (Lien). The twist is that he wants you to pay the guarentee premium and in the event that things go belly up and you need to make a claim you may end up chasing it through the courts. Don't place too much reliance on the late penalty clause, many mass development contracts have that and most run late, but I don't know of anyone that has actually managed to get paid out.
