Someone with more knowledge on this will hopefully answer, but this may refer to the building and not your wife. Was it a new build as I believe the builder has to get a `habitation certificate` for a new build, and as far as I am aware does not apply to re sells.

hi, we also bought a couple of years ago and have had to pay out on the certificate of habitability,it set us back approx £500, on occasion the building contractor does this for you but not in our case,

We are in the same situation
Do you have your TAPU and if you do have you registered the Electric and water in your name, as I heard you can't do this unless yo h have the Habitation cert

I have been digging around on the subject of "Habitation cerificates", the authorities are cracking down more, in the past they have been lenient on the certificate, and so have the utility companies, many older properties do not have the correct certificate but have been able to have water and electric connected, now however, they are becoming a little more diligent. Resales, are now being checked by more careful agents and informing the vendors or buyers. New builds, some developers are now applying and paying for the habitation certificate prior to selling.
It also affects any changes to the property, like opening part of the roof into a terrace, having the certificate saves all the added hassles from authorities.
No matter what age the property is, it is better to ask.
Just another query to add to the list of questions to ask. But I am sure that one of our agent members could explain this much better and in more detail.

Lorraine you are correct in what you say the authorities are cracking down on this and now the utility companies will not supply electric and water without the ferdi iskan or habitation certificate, and in Antalya the water company will not accept a photo copy but want to see the original documents. Any buyer should see all the documents and any good agent should supply them and explain them and if the habittation certificate hasnt been completed (buying in build) then your contract should clearly state who is paying for it.

only after reading posts re: Habitation Certificates on this forum have I found out our complex does not have one. I bought my apartment whilst still under construction, and didnt know about Habitation Certificates then! I did use a solicitor at the time, who didnt mention Habitation Certificates either. My questions now are, who is liable to get these? the builder, or the owners of the apartments? Is the £400 fee per apartment, or per complex? And if we have to get our own, how do I go about doing this?
Many thanks in advance for any help, as I have no idea where to start on this!

Sandra your post demonstrates that even with a lawyer things arent allways perfect here!!
For those who need it:
To find out if you have the habitation certificate or "Ferdi Iskan" take your tapu to the local Belidiye and ask if it has been done if they say yes then get a copy of it and keep with your tapu and other documents as it makes it easier when you sell if you have the documentation to show potential buyers, (although as an agent even if I am given the copies I still check them out for authenticity ). Whilst you are at the Belidiye get a copy of the Genel Iskan as well.
IF you havent got the habitation certificate then its a simple task of asking how much it is and then paying for it and then getting a copy of it.
