Hi,
Yes i have heard that story. Think it was something to do with the building permission. I heard that the Hab had to be applied before 5 years expires.
Dont know wether this is fact though.

I'm going to Turkey early next week to (hopefully) sort out this Ferdi Iskan business. I have a copy of the Building Use Document (Yapi Kulanma).
I would be very grateful if someone could explain in simple terms how to go about getting the Ferdi Iskan and how much does it cost.

I think the builder needs to get that from the council, it depends on your property, who build it, if its part of a co-op, when it was finished and if it's to building spec. etc.
Your agent should be able to take you to the appropriate office to get it sorted.

I also think that if they have been applied for (by the builder) then it is possible that the Beledieye (council) may already have the copy to give you.Worth asking them first before parting with any cash.

Thank you for your replies.
I will contact the agent but I am not optimistic because when I asked for the Ferdi Iskan the document she gave me was a photocopy of the Yapi Kulanma which dates back to December 2001. The site is a co-operative which was supposed to be wound up last year but couldn't because 3 of the owners still had debts. Last I heard it was to be wound up by the AGM this summer.
When we bought our house in 2003 I thought that once we had our Tapu then everything was done and dusted. I knew nothing about a habitation certificate until I read about it on the internet.
Is getting the Ferdi Iskan a very complicated procedure?

Well, for what it's worth, here's what I found out on my trip to Turkey to sort out our Habitation Certificate. Our house is on a co-operative site, so this may not apply on sites that are not co-operatives. At last summer's AGM the members voted to dissolve our co-operative but it takes a year after the vote to wind it up officially.
Although we had our Tapu, many of our neighbours are only getting their Tapu now. I don't know the reason for that - perhaps the original owner of our house paid in full befores selling the house to us and the neighbours had outstanding payments. We pay annual property tax or Emlak Tax as the neighbours call it. Our water bills are in our own name and we pay our water charges direct to the Belediye. Our electricity costs are calculated by the sitesi committee but our neighbour pays our electricity charges direct to the electricity company on our behalf. Our electricity bills can be quite steep.
According to my Emlak, my neighbours and the people in the local Belediye, the Kulanma is the Iskan and it has no expiry date. Our neighbour's Kulanma has his name on it but ours has the name of the co-operative only and I have been assured by the Belediye officials that it doesn't matter whose name appears on the document. Our neighbour's Kulanma is an original whereas ours is a photocopy, but I have been assured that that doesn't matter either provided the photocopy contains the official stamp of the Belediye. In other words, if you have a photocopy take it to the Belediye to get it stamped. I noticed, also, that our neighbour's Kulanma is a two-page document whereas ours is a single page and when I queried this with the Belediye they said that it doesn't matter because ours is simply an older document, so some of you may well have extra paragraphs on your Kulanma that do not appear on Westonalan's translated sample.
There are two crosses in the Kat Irtafaki section of our Tapu and I asked how to get our Tapu changed to reflect the fact that our house is finished. The reply from the Baskan was something to the effect that at next year's AGM all owners will be given the option to pay a certain amount of money and provided everyone pays up we all will receive a copy of the site plan which will magic away the crosses from the Tapu. The reply from the emlak and from the Belediye was that all owners are required to have a Dask and a Kulanma at a cost of a few hundred YTL each before I can get my Tapu changed and that the cost to me for changing the Tapu will be in the region of 200 YTL. They told me that everyone's Tapu will have crosses in the Kat Irtifaki section regardless of whether their house has been completed and no-one's Tapu can be changed until everyone's Tapu can be changed, so I take it that the Ferdi Iskan is issued for the sitesi rather than for each individual property. This seems to confirm the statement on the Turkish Embassy's UK website that the important documents to have when selling your house are the Tapu and the Kulanma.
Hope the above makes sense and that it helps others in a similar position to ourselves. If there are any inaccuracies, please, please post a correction.

Can anyone tell me how they work out the price of this habital iskan? As most people say the developer should pay the iskan but in most cases its the buyer who has to foot the bill?? Also does everyone have to have iskan? By this i mean do Turkish people also have to have a habital iskan as if your in a builing say 40 homes each paying 2000 lira for this iskan it works out very expensive.
Appreciate any help on this.
