Ok, I was happy with my purchase in Turkey until I read this article and got to the section where Kat Irtifaki is mentioned, quick check of my TAPU and yes - it's Kat Irtifaki. (box checked)
I have bought an apartment on a small development, 1 of 15 with communal swimming pool from a private developer through a solicitor. Thought I'd followed everyones advice to buy the correct way and left nothing to chance.
Can someone please explain the significance of Kat Irtifaki and let me know if I'm (and the others on my development) in trouble and what do we need to so to resolve. Bryn? Mustaq?
I have to confess I queried this a few months ago because I thought it translated as access rights, but because it's a apartment block and communal ground I thought it might be correct. Now I don't know where I stand.
Help!!! Anyone??

Kat Irtifaki from what I managed to find out is where the habitation permission has not yet been granted, could be that the Tapu was issued before that or the site was not complete at the time?
Do you have your habitation certificate now?

Hi Mushtaq,
First of all, apologies - I spelled your name incorrectly in my original post.
I have asked about the habitation certificate, and have been told it's all OK, but haven't got a copy yet. I'll be back over later this month and will check again then and do my best to get a copy.
Which prompts another question - Do I now need to get the TAPU changed to reflect 'Full use' or whatever the translation?

Terry Kat irtifaki tapu is issued as Mushtaq has stated this would be the case for a property in build, it will indicate one or two things or both, 1st the genel iskan isnt done 2nd the Ferdi iskan(hab Cert) isnt done 3rd both arent done. You need to check the status of the genel iskan and Ferdi iskan and then can get the Tapu changed. you will need copies of the documents from the belidiye and take them to the kadastro to change the tapu which wont cost much. Alternatively if you have copies of the documents from the Belidiye you dont have to do the change immediatly you can do it when you eventually sell it. One thing Terry go to the belidiye yourself or with your agent and sight the originals I have seen some very good fake documentation here.
The final TAPU should say KAT MÜLİYETİ

That's clarified it for me, I understand the Hab Cert but what's the Genel Iskan?
Boy am I going to have some fun with my agent and builder when I get over at the end of the month, in June they told me everything was complete and I had nothing else to do! They also joked I could see it the next day if I wanted!
I'll get a trip down to Bitez belidiye with a Turkish friend and clarify what the situation is.
I'm correct in saying I can't sell the place until this is all sorted out? And waiting until then to sort everthing out wouldn't be a good idea, heavens knows where the builder/agent might be in 3-4 years time?

The Genel Iskan is to do with the overall checks on the building (or complex) and is to do with roof heights, wall sizes and actual position in the plot, e.g. as specified in the original planning application etc.
Definitely an issue to get sorted just now.

TJD As john has said genel iskan is the overall building checks and can been equated to getting an english planning permission signed off when you do a build in england. The ferdi iskan or Hab cert cannot be obtained until the genel iskan has been signed off and you need the ferdi iskan to get proper water and electricity connections done.
