Adding a foreigner's name to a Tapu...
Hi, I would appreciate some guidance, it will probably sound daft but I have to start somewhere. My husband and I (no I'm not the Queen lol) have bought a villa a year ago in the Fethiye area, but for some reason the Tapu office at the time, refused to add my name to the Tapu, saying that because I was a New Zealander I could not buy property in Turkey(!) My husband is English so his name is on the Tapu, minus mine. We have since found out from the NZ consulate in Ankara that this action was wrong, and that it is legal for N.Zealanders to buy property in Turkey. I presume I will have to go through the application process all over again, have the documents notarised etc, at extra cost to me, although this was not my fault, in order to have my name on the Tapu as a joint owner with my husband. My question is, how do I go about this.. I'm a bit lost as to what papers I will now need, or whether I can just go to the Tapu office and ask them to add my name? Do they speak enough English there to understand this situation? Appreciate any comments, and has the same/similar thing happened to anyone else?

to get your name added to the tapu you will have to apply for military clearance[just as your husband did] it is a pain to have to do it but its the only way .. my wife,s name is not on our tapu ,so rather than go through all that i have made a turkish will leaving her the property in case of my demise . after consulting a turkish solicitor it seems that was the cheapest and easiest way out of the problem .in any case you may have to get a turkish solicitor to go through the motions of applying for and obtaining military clearance before you can even start to get your name added to the tapu which will incurr extra cost as well .

when it comes to Turkish wills for Real Estate there are a lot of hoops to go through..and costly ones at that when it comes to getting the probate...it isnt plain sailing no matter what your solicitor will tell you...(unless of course he explains about the reserved portion)

Hi There,
They did the same thing to us-I'm Canadian. The Tapu was issued only in my husbands name so now he charges me rent when we go on holiday.

i could be wrong ,but when we went 3 weeks ago i was looking at the entry visa charge for diff nationalities and i was sure it said canadian entry visa was about £30 . it was the only one at that price on the board at bodrum a/port.

biggles - if you have children together and love your own blood relatives I'd agree with your solution.
both me and my partner would HATE the adults from our extended family to gain anything from our deaths, in addition we have his and her plus together children there is no way either of us could go with your solution. If we had had a mix up I would have paid for the change of deed.

Hi Biggles,
Yep I do already have military clearance etc, all that had been done, along with hubby's, it was just a clerk at the Tapu office who at the last minute when we went to collect the Tapu with the builder, who then said that Kiwis couldn't buy (thought she meant fly at first..), we were gobsmacked. Thanks for the advice tho. I might go back armed with a fat sozluk and see how I get on... :-/ I know its not a matter of life or deatrh, just the principle. we have made a Turkish will so I have protected my interest (lol)

Hi, yes we are selling up, but to move to something a bit smaller, with a few less stairs (looking to the future lol), nought to do with the Tapu problem. It was more a question of do they now know that NZer's can buy, can they sort it, then again is it worth the hassle. Maybe not! At least if we buy again, We know what the crack is, and if necessary, stand our ground. Its possible that few Kiwis have ever bought in Fethiye.. thanks for your help anyway!
