Things to bear in mind with writing your question;
  • Make is concise but with enough information to get the answer
  • Format your query so that it's readable
  • Don't ask questions here that could be answer by other members in General forum.
  • Don't expect full legal service for Free, if you have a difficult problem then you need to see a legal expert, maybe Cem can help but be prepared to pay.
  • We don't want to take advantage of Cem's offer.
Cem,
We have a major problem with our house in Turkey. Five years ago we decided to put the house on the market and we asked several estate agents to advertise it. After a couple of years there was only a little interest in it and we asked one of these agents what we should do. He advised us to renovate the house as it was getting a bit shabby and subject to damp and we would then be able to rent it out. He brought several different builders to check the house and sent us various quotations for the work which now had turned out to be quite considerable involving lots of insulation work and consequently very expensive.
The agent was very insistant that the work was necessary and that the house would never be fit for habitation. We informed him that we didnt have that kind of money and sent him an email telling him not to do the work . Around a week later we received a series of photographs showing us the work that had been done on the house and a description of all the jobs done.
Looking at the photographs it seemed hard to justify the amount allegedly spent. We decided we needed to go out to see the house first hand. When we were being shown around by the estate agent we became convinced very quickly that the work done was considerably less than that claimed. We sought advice from friends who recommended a solicitor. The plan was to have an independant team of court inspectors check out the work which HAD been done and then we would offer to pay the amount suggested. We were also advised to change the locks on the house. The solicitor asked for money up front to pay the court inspectors.
We were about to fly back home, thinking we had done as much as we could to protect our interests when the errant estate agent persued us to our hotel asking for the keys, telling us he had families ready to move in and rent out the house. We found this hard to believe as it was NOT in good condition (despite the large amount spent on it!) We had him hassling us for at least four hours before our flight but refused to give him the keys.
Several days after arriving home we were contacted by the solicitor to say that the court inspectors had been unable to gain admittance to our house as the locks had been changed again. We found out who had changed them a week later when the we had several phone calls and emails from neighbours in Turkey complaining about the noise from "our" tennants. Our solicitor (who has POA) seems powerless and says the only way forward is to go to court. We are reluctant to do this as very rarely do foreigners manage to get their costs back. What do you suggest we do next?

What Does my Tapu Say on it?

This question is perhaps the most often asked question by foreign property owners in Turkey.

Good news, fortunately, is now you can get the answers from qualified experts, and it's free, for a while at least. PM me for more information. Or visit mytapu dot com, and the light blue box a little way down the page ....

Hi McB, would you please make clear your association with mytapu?

You have been asking people to PM you for information or directing them to the site where I find no contact information, seems to be like just a virtual company, the type I would associate with phishing scams.

Please note soliciting for business is not allowed on the forum unless you pay for a banner advert.

May I take this opportunity to make it clear to everyone that TLF does NOT endorse ANY business adverting here or recommended by members, any recommendations should be treated with caution and you should investigate the companies and individuals yourself.

From previous experiences an individual's experience could be just that, it does not mean your experience would be the same, treat everyone with suspicion when it comes to money and you wouldn't be far off, and probably save yourself heartaches.

Re: Legal questions

Can I ask a question?
My Turkish husband owns land just outside Fethiye. On a recent visit, he found out that the land boundaries had been re-drawn, and he has lost a chunk of land, now owned by someone else.
Apparently notices were posted at the Town Hall, but he has missed the time allowed to appeal. He consulted a Solicitor, but she didnt seem very interested in the case. Is there any hope of re-claiming his land?
Thanks in anticipation for any advice.

Re: Legal questions

Does the Belediye have a record of your current address?
If you dont register your permanent/other address and other contact details with them they cannot contact you. They can only leave a notice at your Turkish address.
This applies also to management services on sitesi.

Re: Legal questions

There was recently a mapping exercise in and around Yalikavak, there are red markings on walls, pavements, roads and everywhere. My neighbour and I gained 5 sq. metres on our humble plot, When we sold we had to have the original Tapu in our names altered to reflect this, before they created the new Tapu for the new owner.
My point being yes they do redraw boundaries, in this case in our favour although I never found out where I suspect it was outside our front gate. The measurements were taken using state of the art equipment, whereas before it may have been someone holding up a pencil.
