tax

I want to know if I add my partners name on the TAPU will we have to pay tax? There will not be any money change hands its just to make sure if I die it transfers to him.

If it will incur taxes roughly how much does this cost?

This will not guarantee it goes to him. Your heirs, if you have them, will be entitled to a share and vice-versa.

Yes, assuming it is less than 5 years since last tapu, it is classed as a sale which will require sales tax and capital gains tax.

To add someone else's name to a Tapu you must treat it as a sale....ie. apply for MC if they're not turkish and also pay 3.3% tax of the half you're "selling" to him.

Immac is right. When you die, the Court will decide who gets your half. The Tapu office require a Document from the court before they will change any names on the Tapu.

is it possible to do a power of attorney so if anything happens your partner can sell the house.would this be possible? im sure somebody on tlf will know.

POA only allows you to act on belhalf of another living person, on death a Will supercedes POA.

As Allison has stated the courts will decide on what happens to the other half however that is based on Turkish law. If you have a uk Will with the proper documentation for presentation at a Turkish court then it is likely your wishes will be honoured.

You can leave whatever you want to whoever you want by way of a uk Will however a `Last Will & Testament` can be contested in a court of law so one must have a valid reason for not leaving to your siblings.

This subject has been talked about before on TLF, but is still a mystery. If there is a Will then one would assume that the person(s) named therein are the heir(s). If only one person is mentioned, i.e. partner/spouse, who decides that there may be other "heirs" who are being disinherited? How does a court find these heirs? How far back in the family are they considering? Children, parents, aunts, uncles, cousins, great relatives, many times removed? Quite apart from which, if it is the "Will" of the deceased that their property is left to someone specific and a court can set this aside, what is the point of making a Will in the first place?

I know that in my own family, there are relatives many times removed that are out there somewhere but with whom I have never had any contact. Is the court going to strive to find these people, and how do they do it? Do they have access to the Records Office in all countries of the world, in order to trace these long lost people? All seems very wrong to me.
