Problems with landlord in Turkey

Since we moved into our house we have had trouble with damp seeping from the toilet waste pipe into the foundations and coming up through the salon walls. We brought this to our landlord's attention but after 5 months he still hasn't rectified it. I threatened to withold the rent but he says we can't as we have a 2 year contract. Is there anything we can do or will we have to put up with this till the contract runs out? The smell is appalling and we can't even have visitors due to this problem.

Start a paper trail with the landlord and once you are saisfied he is doing nothing about it, move. If you can prove that he has not addressed the problem, the contract does not stand. A recorded letter or witnesses would be a good idea. I am assuming the landlord is Turkish given your hesitation to say stuff you and move.

It is his responsibility! Try the Muhtar to sort this out, if not the public health department at the Belediye, probably comes under the Zabita, last of all the Jandarma. If all else fails, get the job done by a reputable plumber willing to give you a report and a reciept and take it out of the rent. Nothing to do with having a two year contract, the other option is to move forget about the contract, he is being unreasonable.

The Turkish way would be to get it done, get a receipt, photocopy it, give it to the landlord with the rent minus the amount paid.

Not all landlords operate like this - mine is great and attends to such things immediately.

i agree with Linda...get the job done and give the bill to your Landlord. İts his property not yours.
when we moved here we had proalems with our toilet and yusuf just had it fixed..same day..and gave the bill to the owner.
İf you like the place stay and get the problem fixed..if not get another apartment..theres plenty about.

if he is failing to do or authorize the repairs, in writing tell him you will be getting the repairs done, as the smell is unbearable and place unhabitable and you would have to leave if this does not get rectified/

Then once repairs done, send him the receipt, and deduct from the rent if he does not re-imburse you immediately.

Then you have covered all grounds -he either agrees or risks losing a tenant and having a void..and chances are if it has that bad smell s/he won't be able to rent out again anyway.

i would find out exacltly what is causing the problem, first thing, get an expert round to check, then decide what course to take.
it may be for example that its a septic tank is full and that its down to you to get it emptied

Having a contract is a good thing, and I presume you pay rent into the landlord' bank account? (Have you those bank receipts in a file?)
You seem to be in a village where the Muhtar is the authority.
The Muhtar can help you write the written notice of the problem, and see that it is delivered ( think then he has to sign for the reeipt of it), and he has to act within so many days- 30?
If not get a notarised letter written ( from Marmaris?) as this repair may cost a good few months rent.
Then get the job done, fully acounted for ( no cash in hand job), and deduct it from his rent.
He is in the wrong.

Thanks people for your advice. I've plenty to think about now and feel as if I have options which I felt we didn't have before. It is the actual waste pipe and our neighbors house has the same problem though even worse! They have decided to move elsewhere as soon as their contract is finished and as said previously there is a property glut at the moment so I may just terminate the contract after consulting a solicitor as the landlord will almost definitely make it awkward to stay there if I pursue this through the authorities.
