Good points the UK notary I dealt with advised on the wording once I explained what I wanted to achieve. Not sure if that's part of their service or not, better to be understand what power you are assigned.

Don't be lazy or trusting, giving a POA can be giving someone a blank cheque book.

This post is really helpful, any advice on the wording for giving POA in a divorce situation? No complex issues around the divorce.

The message really is be precise in your instructions stating exactly what you you want the person to do and avoid any generalities . If there is something in the divorce procedure that you do not want them to act on then state it.Ensure and make clear that they do not take ownership of any financial matters arising, whether monies or property or goods, and that they are acting as agent and not "in loco parentis".You should also put a time limit on the POA, you can always extend.

By the way Mushtaq you should add Residency Visa Number to the information required from the person taking out the POA if they have one.

I'm just wondering IF something like below will be accepted as it really limits the "POA" to the bare minimum.



“Power of Attorney”

I ___________________ (herein the “owner”) hereby grant to __________________________ (herein the “agent”) the power of attorney (herein the “POA”) to sell my Villa, at the address: _______________________________ (herein the “owners property”) for a minimum of xx,xxxTL, or more (herein the “sales price”).

Once a ”sales price” is agreed with an interested person (herein the “buyer”), the ”agent” shall ensure said cash is deposited in full into the “owner’s” bank account: ________________ (herein the “owners account”).

Only after said full transfer of cash is confirmed as cleared into the “owners account” can the ”agent” release the Tapu to the “buyer” – NO EXCEPTIONS WHATSOEVER.

Once said cash is transferred full and clear into the “owners account” shall this ”POA” come to an end.

This is the entire extent to which the “POA” can be used as NO other power is granted whatsoever.

If the “owner’s property” is unsold 120 days from today, this “POA” shall be deemed null and void and not valid.

The “agent” shall be due a fee of x,xxxTL but only IF they successfully sell the “owners property” and the cash from said sale is full and cleared inside the “owners account”.

In the event the “owner” sells the “property” themselves, or via a third-party, the “agent” shall not receive ANY fee whatsoever.
