proxy voting

With regard to proxy voting at AGM's , can anyone clarify the following for me please:

1. Does the proxy have to be a fellow owner or can it be anybody who is willing to attend?

2. Can the proxy vote be a carte blanche vote giving authority to the nominated representative to vote in any way the representative sees fit OR does the proxy have to be related to specific motions.

As far as I am aware it can be anyone who has your written authority and this is how it is interpreted on our site.
Whilst I am sure that you can limit the proxy to a single motion the problem would be that as soon as an amendment to the motion is proposed the proxy has no authority to vote on this unless your proxy said so - in which case it is for more than one motion. You have also got to consider the practicality of asking someone to sit through a whole meeting in order to vote on one item

we have 42 apartments on our complex and have been told by our solicitor that on a complex the size of ours an owner can votefor themselves and act as proxy for 2 other owners. A proxy who is not an owner can act on behalf of two owners

It may be worth checking your existing maintenance agreement (Yonetim Plani) which you can get free of charge from your Tapu office.

Yes the Condominium Law says the maximum you can act as proxy for is two owners.The maintenance Agreement or any other document cannot vary the law except to the extent allowed by the law.

A Proxy Vote can be given to anyone, Solicitor, fellow owners, person of your choosing or management company looking after your property.......they are in effect YOU.

The agenda should be issued at least 15 days before the meeting along with the accounts. This allows you to instruct your Proxy Vote Holder to vote according to your wishes or instruction.
