hypothec

In very simple language, can someone explain what this is please.
We have been asked for another 400 to remove the hypothec we apparently had on an apartment we sold nearly 5 years ago.

Thanks for that - one more question - has anyone out there had one of these hypothecs (or Ipotek) removed from a property and if so, roughly how much did it cost? We still think 300 is a bit steep.

First posting you said 400 -- even 300 sounds like another Turkish Rip Off to me , I would investigate this further before paying anything

Firstly why would you want to remove it, secondly if the buyer or buyers lawyer had done their job properly at the time of sale the ipotek would have become apparrent, therefore in my humble opinion its down to them to pay. i would do nothing

If one assumes that the property had a Tapu and this was processed at the time of the sale 5 years ago it would not have been possible for the Tapu to have been transferred by the Tapu office with any outstanding debts or promissory notes which is basically what an ipotek is on it. The sale having taken place 5 years ago suggest someone is trying to have you on.

I would suggest you backtrack your paperwork and if you made a copy of the Tapu before selling all the evidence will be there for you to see. Don’t become another victim to these crooks. How have they managed to track you down after all this time? The only likely people to be after you would be a state office if there has genuinely been a mistake, if this is an emlak or the buyer you are being duped.

Thanks guys - knew you would come up trumps.
Its a rather long, boring and usual Turkish property **** up story.
We sold our apartment 5 years ago, got the money, everything hunky-dory.
5 years down the line it is discovered that the process had never been properly done and that we actually still legally own it.
Not very fair on poor Belgian chap who had given us all that money for an apartment.
So basically we started from scratch with all the legal paper work of selling the apartment to our belgian, but without him giving us any more money for the place - because he had already done that in full.
This is the last bit, the disolving of the old hypothec that we must have had on the place when we originally bought it nearly 8 years ago now.
Don't remember having one but lawyer tells us it there and that they can't complete the sale to the Belgian until it is un-done.
For which they want 300 (definatly 300, my mistake first time round) and we are about to say 'on your bike mate - its cost us 1000 already in legal fees for something we don't much care about'.
So, are we right or are we wrong.- can't bear to go through the same drama if we ever (ever) sell our villa.
Your thoughts, oh wise ones, would appreciated as ever.

Oh, and why has the writting on this screen gone all little - thought I was wearing the Dearly Beloveds specs.

Seems a very strange situ to me -- I am so sorry for you both as I know you do not like Turkey and want to sell your villa also , I still would not part with 300 though

Please be assured we certainly do not hate Turkey, we have some very fond memories of being in Yalikavak. But the villa we stupidly bought (after selling the apartment) is way too big for an occasional holiday home and needs to go to someone who would use it more.
As to the legal wrangles we are having, well I am sure far worse can happen in many other countries and its hardly life threatening - just slightly irritating when you are too far away to deal with it face to face.
Anyway, come on you lot, we want more of your valued opinions on these fees and wether or not this Hypothec thingy needs disolving or not.
