Flight Delay Compensation

A relative was on a scheduled flight (Birmingham to Dalaman) yesterday. Pilot was taken ill part way through the flight and plane sent back to Gatwick. Put up overnight and re-scheduled for this morning. She will arrive this afternoon instead of yesterday evening.

Does she qualify for compensation for the delay?

Similar happened to me a few years ago but we ended up being accommodated for 24 hours in Greece. We tried to get compensation but our insurance refused to pay stating that the airline had done everything possible to remedy the situation.

We had a flight cancelled back to the UK. Plane had problems. We too were put up for the night in an hotel in Bodrum, with all meals. However, we did eventually get compensation from our insurance company. It took over three months and a lot of persistence. Major problem was Thomas Cook. They gave us a letter when we got back to the UK, but the insurance company was not satisfied. They wanted more information that Thomas Cook was very slow in providing. But we got there in the end. About fifteen to twenty emails and several letters with copies of T. Cook information.

Was it worth it for 20.00 each? I would say yes. This is what you pay your insurance for, and you are entitled to it.

This web site suggests €400 if:

"The only possible stumbling block occurs when trying to define if a delay is or isn't within the airline's control. Airlines are exempt from paying out compensation if cancellations are due to ‘extraordinary circumstances'. Basically, this covers unpreventable events such as extreme weather conditions, security risks and workers going on strike"

I would suspect that the pilot being taken ill part way through the flight would come under the "extraordinary circumstances" category.

We had a flight delayed to Florida some years ago and were put up overnight at Gatwick airport (in a hotel). We tried claiming as we lost nearly 2 days of our holiday but received nothing.

I wonder if crew illness is the get-out? Could they be expected to keep a service running in the event of staff sickness? Should they not have standby crew to cover - like any other business - does it take nearly 24 hours to find a pilot?

We were once delayed as the crew had not turned up! It took hours to get a replacement crew. But they managed it within the time after which compensation would have been due. Surprise, surprise.

Difficult to say if illness is "allowed". I know we had much difficulty in convincing our insurance company that the technical problem was not that the computers in the airport had broken down, or the meals had not arrived, or anything else other than the plane itself. I got quite stroppy in the end and asked if an engineer's report was being requested, and pointed out that it would be quite difficult to get this. Eventually, they accepted T. Cook's very sketchy explanation for the delay.

I think the key here is persistence. If you fall at the first refusal hurdle, you are done for! Moan, wheedle, cajole if necessary. But at the end of the day - you are entitled, and tell them so!

What is the point of having co-pilot if all the co-pilot is going to do is to turn the plane around, or is this to save them having to fly out a relief pilot which I doubt, obviously there would be more reasons than we will ever know, but it does sound ridiculous.

Maybe because of illness it's cheaper for the airline to do the turn-around sooner than possibly suffer high medical costs in whichever country they put down in.

I tracked the flight on one of the web sites that allows you to see the track in real time. They were half way here before they turned round. It would have been just as long/short to continue to Dalaman.
I suspect it allows them to resume their schedule - planes in the right places - if they delayed it to today, which is why I am being a bit bolshy on behalf of someone who has not even arrived! But I have wasted a day and had to make two trips to Dalaman.
