Rural land and Ltd companies help?
Does anyone know if the rules have changed yet re buying in rural areas (outside belidiye) as a foreigner without a company? The kadastro wll tell me nothing, the accountant knows nothing and the tapu office is ambiguous! Long story but we had to set up a company after finding out that the boundaries had changed inbetween buying and getting tapu so a house that we legaly owned through a co-op we couldn't have in our own name, when we found our land, as we already had a company we put the land into it to. Now we want to sell the 1st house and the company but the land (and house we live in now) is still in the company name, I'm don't think that the 'buying outside of a belidiye' has gone through yet and now I don't know how to get the land off the company short of putting in someone elses name, has anyone got any ideas? I think i've read somewhere that you can put a tapu in someone elses name but then have a stop to selling/adding debt etc put on it, has anyone done this? We want to get rid of the company while we have this chance but its proving harder than i thought! Or can I 'buy' the land with a turkish friend (her owning 1%, me the other 99%), would that work?

I donīt know if the rule has changed but I would advise against sharing ownership in the way you suggest. If she steps in front of a bus (or some similar disaster) then her family have a say over what is yours because they will own her share.

Thanks Ian, I know it's a risk but it's a last resort, having a company was more or less forced on us by owning on the co-op, we didn't at the time want to put anything in someone elses name, we don't now either but I can't find another alternative? We're trying to sell both properties but we have one buyer interested already for the 1st house that may be prepared to take on the company, don't want to lose that sale because we can't get the 2nd property out of the company name. Some days I really wish we had just rented!

Sara - I asked about foreigners buying where you and I are and the consensus amongst the muhtars is that the rules are not going to change. Did you also know that all the land in our area is being remeasured and after it has been done you have 10 days to complain if you think that your boundaries are incorrect.

Hiya, we had our boundaries done last year, still in dispute over one piece of land, major arguments and now court as they have stolen 1500m2 and given it to someone else, despite having the paperwork proving it is ours! Our Muhktar is trying to find out from the tapu office, we know it will change when Bodrum becomes this super Belidiye but want to try and sort it out before that as that could take 3 years.

Hi Sara,
I have a similar position to yours and wondered how you resolved this. I bought a piece of land in a rural location near Kalkan a few years ago and was advised to set up a company to do this. I did so. I am now in the process of building a villa on the land and want to transfer the TAPU into private ownership from the company and close the company. Can you tell me if this is what you did with your company and property and what the process was, how much it cost and how long it took please.

We own a house in a restricted area and we have just (a week ago) taken possession of our tapu.

Why can't your company sell the property to you as a private individual? This can be done in UK and Turkish property law is broadly similar.

I am in the process of selling the other house that's also in the company name, this needs to be gone before I can deal with the village house so it's all on hold at the minute. We have asked at the tapu office, he checked by our parcel number and told us we could own it in our own names as foreigners but we now have to wait (for the other house to go through the sale) to sell it from our company to me personally so unfortunately I don't know any costs involved yet, I presume military clearance and tapu fees come into it? Hopefully will be at the tapu office tomorrow and can check, will let you know if I find out anything else

It's not the same as in the UK, we weren't allowed to buy here as foreigners, hence the need for the company to own it, therefore the company can only sell to people that are allowed to buy here, which until last year was Turkish citizens only.
