Ipotek and Inheritance Law

Hi, can anyone advise in the situation where there is an ipotek on a property and the property owner dies - is the ipotek cleared before the property passes to the deceased inheritor/(s)? Thanks in advance for any clarification. Helen x

I think this is a question for the Tapu office really. I woukd be surpriser if the debt dies with the Tapu holder as the property still forms part of their estate.

I have been trawling the archives on here and came across:

"I think an Ipotek takes precedence over inheritance, because Inheritance is divided on net assets meaning after debts etc. are paid off, an Ipotek is a debts registered on the property, so will need to be paid off, so I think it's a good way around the Inheritance Laws of Turkey."
