Cheating Turkish boss

Hey, this is actually a question on my fiances behalf, she is Turkish btw. We are battling with her boss this week because... well... hes a lying, cheating thief to put it nicely.

She started working for him 9 weeks ago and he told her he would pay her 1000tl for the first month which would be a training/trial, and then 1500 thereafter. She actually did 5 weeks of training, a bit more than he said but still, then at the end of those 5 weeks he said he will accept her and does she also accept to work with him, and she accepted. So she continued working for him, and during the last month has asked him about 5 times to make her a contract and start her "insurance" as Turkish people say (to my knowledge this insurance is basically income tax), and each time he has a different excuse. Anyway another month passed and it came to payday last friday. But when she checked in her bank account she only found 1000 liras... of course she called him up and unbelievably he claimed on the phone that he never ever told her that it would be 1500 and her wage would always only be 1000, which is a complete lie. They then met up to discuss this where he shouted and insulted her.

We then did some research and spoke to some friends who said actually he should also pay 2 weeks unemployment pay for effectively firing her (it is 2 weeks for a person who has worked less than 6 months), and also he should pay the insurance money for her. Totally adding up to 1825 lira. She told him this on the phone and he continued to shout more, actually said she is stealing from his unborn baby...

She gave him the choice, either pay the money he owes her, or she will take it to the court and he will also get in trouble for also not paying the taxes which I believe has a very large fine.

Since this conversation she has tried to call him again to resolve the matter but he is since ignoring her calls. We don't want to go down this bad road, especially as we were planning to leave turkey in the next 5 months but are unsure what to do now, it might not seem like a huge amount of money for some people but for us, at this moment especially it is, not to mention the fact of being cheated and put into this position.

Does anyone with legal knowledge or without have any opinion on what we can do in this situation?

If you're planning to leave Turkey in next five months, then put it down to (bad) experience.

If you're staying, then unless you've got the money to take out a court case, then put it down to (bad) experience.

The thing is if he doesn't pay the money he owes her in the least she can make a complaint to the government that he refused to pay her taxes, and he will have to pay 10x this amount of money. Yet she doesn't want to say that so directly because it sounds more like blackmail, but she just wants what is owed to her. And btw the reason we are leaving turkey is because of situations like this, which we have both been in on too many occasions.

Apart from the Bank transfer into her account is there any paperwork to show that she was in fact employed by this man. If not, as John F has put, she can only put it down to experience. As you say it is the reason why you are leaving Turkey and sadly to say, it seems to be the way many employers treat their employees.

When you see the way Turkish staff in the tourist sector are treated- some working all season with promise of wages at the end, but getting nothing, its simply disgusting that employers get away with it

Yes, her job was for a realestate consulting company, she has many official papers giving her permission to access government files regarding properties, also 100s of emails, and even a recorded conversation of her boss arrogantly telling her that she has no proof.... I figured it would just be a case of shouting at him a few times until he realized the trouble he would be in if he didnt pay up, but now he is actually ignoring her calls, for some reason he doesnt seem to be scared of her reporting him at all.

you will get nowhere
so i would repeat what has already been said..chalk it up to experience ..real estate business is notorious for not paying dues
its dreadful but he certainly wont pay her unless you hold him up with a double barrel shotgun..and even then you wont get it.

Report him to the tax man and take it as a "life lesson" at least she got a part of her wages, there are a lot of lads who work a whole 6 month season and get NOTHING at all.

And you should name him too, then members/Friends and family here will know not to give this dishonest apology of a man any business!
