Tazminat if leaving ones job?

I am a foreigner who has worked for a private school in Istanbul for the past 11 years, and am about to resign and leave the country. Am I entitled to anything in the way of severance pay (tazminat?) or SSK payments? I have colleagues who have either had to retire (because they had reached 65), or their contract was not renewed, and in each case they received substantial 'tazminat' payments. What is my position, after 11 years of service to my school employer?

Turkish staff are entitled to one month's pay for every year they have worked when they leave. If I were you, I'd push for the same.

Hello Karolm,

Actually I'm no longer an active member of this site as a professional but have seen your question while looking over the posts. I'll shortly give you some infos regarding Turkish labour law and I hope this will avail.

An employee who has a 15 years of work record in the aggregate(may be within several employers) may demand his/her severance pay from the last employer as long as he/she has worked 3600 days in this position.

With another saying; you have the right to demand your severance pay from your employer(considering that you had worked longer than 3600 days there) if you also had a 15 years of work record(may be in several employers) in Turkey.

If you hadn't work for 15 years, you unfortunately can not demand this pay from your employer unless you had a righteous cause to terminate the contract

From the other hand, if you don't have a righteous cause to terminate the contract, you'll be obliged to pay a dismissal pay to your employer unless you had sent a notice 8 weeks before you left the job.

Turkey is just amazing , not only is an employee little better off than an indentured slave , they have to pay the employer to leave ?

Medieval or what ?

More akin to serving a notice period of a 'contract' - such penalties can also be enforced in the UK IF it is written in your contract.

So not really medieval...

It's not a correct approah to the issue.

This pay shall be paid by the employer as well if he/she didn't send a notice to the employee a while before termination.

Fair enough Jamster , my current employer , one of the largest in the Uk and Europe never enforces such.

It is generally considered to be too restrictive these days.

Several attempts by Banks to enforce these constraints in court have failed recently.

So 8 weeks for a general employee , far to onerous imho.

As for " the employer " paying...... i personally know two employees not to receive a lira after working all summer , let us see them go to court. What a laugh.
