AGM and proxy vote ?

how many proxy votes can one member carry ? i.e. if some people cant attend the agm and have to give their proxy vote to a member who is attending , how many proxy votes can the attending member carry ? thanks

If more than 40 apartments/villas then maximum is 5% of total number. If 40 or less then you can represent maximum of 2. This assumes that you only own one property yourself.

Maximum in your own right is 1/3 of total number of villas - ie 4 votes

As there are less than 40 villas maximum proxies is 2 votes per person( not ownerships).

Making in this instance a maximum of 6 votes

All this is covered in the Condominium Law and are I understand matters which the Management Plan cannot alter.

If one peron owns (does that mean member) more than 1 apartment how many votes and proxy votes can they have at a AGM.?

Can anyone put proxy votes forward at a AGM if so how many?

Further to the last post can any when help with this example?

64 apartments in total on the complex
1 owner has 2 apartments
At an AGM does this owner have 2 votes 1 for each of his apartments and 6 proxy votes, 3 for each apartment - making a total of,
2 + 6 = 8

No you cannot have more votes than apartments and either by being present and voting or if not present nominating a proxy, usually in advance of the meeting, who can in your example have both votes. Its all explained in Article 31 of the Condominium Law of which there are numerous English translations available

ARTICLE 31- Each apartment owner, regardless of his land share, has only one vote.


Whereas the apartment owner who possesses more than one independent apartment shall have one votes for each independent apartment. Nevertheless, no matter how many independent apartments one has, the maximum number of votes that an individual apartment owner has, can not exceed one third of the total number of votes. (fractional numbers are not taken into account in the process of calculating votes) If there is more than one owner of an independent apartment, only one of them is chosen as the representative of the others.


(Amendment of date:28.11.2007-5711/Article 16)

Apartment owners can vote through a responsible person nominated by proxy to represent them in the board meeting. One person cannot be assigned as the representative to use more than 5% of the total number of votes. However, as per the immovable assets which are subject to forty or less independent apartment ownerships one person can represent a maximum of two apartment owners."

we are having an AGM in early september and were made legal last year,can anyone advise ie what one has to do to have proxy vote,also does one have to inform before meeting what is on agenda or can these be brought up on day of AGM,any other advice would be greatly appreciated.

Its in my post above . The form of words may be in your Management Plan if not a simple note saying who you are/your property and who you nominate to act as proxy is sufficent . It is on our site.We have a standard Agenda which is very similar to any amateur club in the UK and matters not on the Agenda are brought up in Any other Business. If its something that requires an 80% of all owners vote under the Condominium Law it is rejected and the persons who raised are asked to bring forward in accordance with those rules. If something that tries to amend the Condominium Law it is rejected as you cannot do that by law.

In the interest of fairness it is best that all agenda is notified to owners before meeting so all can vote.Could also be alleged that certain items were held back until meeting knowing that those present would pass the motion. Our rule was that all items had to sent to Board 1 week before meeting.
