Question urgent help - sennets a legal question

Hi there, can anyone help please. I have some money owed to me - long story - instructed Bailiffs via solicitor, debtor now wants to sign sennets (not sure of spelling here) and my solicitor thinks a great idea. However, debtor is going back to England, maybe for a couple of weeks, maybe longer, I dont know, are sennets (?) still valid if debtor is out of Turkey? The Bailiffs are not being de-instructed until debt is cleared but solicitor not sure the value of fixtures fittings ect will cover my debt. so recommends the sennet (?) which is over three years. Just wondered if sennets (s) are invalid if debtor is out of the country. I am on a very tight time scale here, less than 24 hours before debtor goes to UK

Your solicitor should be giving you this information. A senet is a Promissory Note, or IOU, legally enforceable against assets in Turkey; I doubt it has any validity outside Turkey. It does not become invalid if the issuer (and his assets) is out of the country, but may be worthless if he has no further connection (assets) with Turkey. Your solicitor may be taking the line that anything is better than nothing.

Sennets are all well and good if your debtor has any assets.

Too many times over the years, I've known people put sennets into the courts here to push payment, only to find that the debtor's home was bought in the wife's name and the bailifs couldn't touch it.
Cars have turned out to be leased vehicles, or bought in another family name, again, these could not be claimed against.

Just recently, a friend actually got as far as having the sennet lodged at court so that a percentage of the debtor's wage (he'd taken a new job) could be taken each month to chip away at the debt.
Unfortunately, it was revealed that another person had beaten them to it and 25% of his wage had been allocated against another debt. The judge virtually told her that she would be placed in a 'queue', as when this first debt was paid off there were other debts to be considered before hers!

I wish you luck, sennets CAN be used to push payment, all too often there's no money to be had and lawyers fees and court fees can get out of hand.

I was told that sennets were or would no longer be valid due to the system not working well anymore. Dont remember where I saw it or who told me, any thoughts on this? Thanks.

My thoughts on this are that there is little point posting something like this with so little research or corroborating evidence. They are still used in this area and locals here still hold them as currency and that, after all, is the basis of any IOU - trust; if you donīt trust the issuer you should not take the senet.
