Another thread on inheritance

Hi,

I know, yet another inheritance thread, I promise I have read a lot of threads on this forum regarding Turkish law and wills, and to be honest I am left a little confused.

My wife and I bought a apartment in Turkey about 7 years ago and never even thought about having a Turkish will drawn up, thinking that our English wills were sufficient.

Both my wife and I had our names on the Tapu.

Sadly almost 3 years ago my wife passed away, leaving myself and our 3 sons.

My wife had drawn up a UK will back in 1995, in which she left all her assets as well as the care of all three sons to me.

It has been a rocky three years, it is only last year that we could bare to visit the apartment which has reminded us that we need to sort out her estate in Turkey, which we had assumed would be dealt with as per her UK will.

Having tonight read through some of the threads on this forum, I am a little confused and it seems that either some laws have changed in the last few years (one sticky thread was dated 2007 and updated that a law had changed in 2009) so it is hard to know what the current position is.

Although I have no problem with our 3 sons inheriting a portion of the property, they are young and somewhat irresponsible, so I can forsee one or more of them deciding they would like sell their share of the property in the event of the first sign of them needing spare money, leaving myself and the remaining son or sons with an awkward financial problem of trying to buy their share.. So part of my would like to retain as much of the property as possible to ensure all sons are able to enjoy the property as my wife would have wished.

I am planning on taking all 3 sons to Turkey later this year so we can sign whatever needs to be signed and provide whatever evidence we need to provide to the relative authorities.

So my questions are...

1. Under Turkish law, as it stands now, what is the legal position with how the property will be divided?

2. What UK legal paperwork should I start collecting? (such as perhaps medical records proving she did not have any other children, a letter from the birth and death authorities that she only registered the birth of 3 children, the death certificate, marraige certificate and birth certificates of the children)

3. Is there anything else that should be done in the UK to prepare for our visit to turkey so we can hopefully resolve this issue during our visit to turkey.

4. How does one get the ball rolling in Turkey with whatever process is needed?
