Maintenance liability

Hi all, If anyone can help I would like to know the answer to this question:

If apartment owners in a complex have their apartment empty/vacant and don't have a water meter or electricity meters
Are those owners exempt from paying any communal maintenance charges?

I would think that All owners are liable for communal maintenance charges irrespective of whether they have meters or no meters..
After all the maintenance charge is for the upkeep of the whole complex.

Reason I'm asking this question, we have Turkish owners who are refusing to pay their maintenance because their apartment is empty and have no meters..

Any advice would be useful.. Thanks

Their argument is rubbish . There are properties totally unsold & empty on our complex [ie never been sold ] But the builders still pay the communal charges & always have . Take them to court for their properties [ auction] or get solicitor to put a charge against their Tapu,s ,that will make them see sense .

I have owned my villa for several years - never lived there/had call for utilities to be connected...

Have paid management fees for ALL that period = one thing has absolutely NOTHING to do with the other.

Evo80 is right - the law is 100% on the managements side...

We had two owners who did not pay for some time because they said they lived in Germany and never visited. Through the Committee a letter was sent saying that if they did not pay what was owed within a specified period proceeding would be started under the Condominium Act to auction their property and send them any residue. I believed the outstanding monies were paid very quickly.. Get your Committee to do the same.

Remind them all that Maintenance covers the sinking fund for the lifts, roof, pool and communal areas as well as wages for caretaker etc. Just put the charge on their properties and that means they can not be sold without a guarantee of repayment to management company.

Thanks for all your replies, your comments were very informative..

What is more infuriating about our situation is the fact one of the Turkish families who are refusing to pay their maintenance on their apartment are supposeably one of Altinkums most respected estate agents....

just goes to show that even the most respected people (with the finances)are still reluctant to pay their share of costs...
