Developer is asking for the original bill 5 years later

In 2007 we purchased a villa in Denizkoy near Candarli, Izmir. The villa was a shell and the estate agent a chap called Bullent undertook the finishing works. He quoted us at each stage which we accepted and paid for as each stage was completed. About 6 months after the work was completed he gave us a bill for over 3000 saying that he hadn't added tax to the work and his accountant had told him he would have to bill us for it. We obviously argued as we had been given a price for each stage and always paid up on time. We refused to pay and were sent solicitors letters making all kinds of threats. In the end we paid a lower agreed sum although we were never happy about it and felt we had been cheated. Up to that stage he had been a great help to us helping us out with all sorts of things. We fell out and have not spoken to him for nearly five years. Today I received an email from him stating that he needed a copy of the original bill he sent us as the government had requested it. Can anyone shed any light on why he should be doing this now. We are clearly very suspicious of anything he requests from us.

i agree with Stuart..somebody will be chasing him for one tax or another..and five years is nothing hee.. we still have to hang on to our old bills accounts fees taxes etc from our business and we finished 9 years ago !

Yes sounds like tax and could be the equivalent of National Insurance non payment of which can cause problems getting a Tapu . As Shirleyanntr says have you got yours. Does not any of the invoices particularly the last identify what your payment is for

Luckily we have our Tapu. I agree that the tax man is after him. I think he was when he tried it on with the original tax bill after we had paid for all his quoted work. I just got quotes such as travertine to all floors and stairs 5000tl and paid it and then got his tax bill later. My argument was that as far as I was concerned al and any tax was included in the quote and bill. I feel that when they came after him he tried it on with us as he thinks all Brits have loads of money.

Take a look at your receipts for the work for which you paid.

If they are official 'Fatura', the KDV (TAX) will be noted on the bottom line and included in the total ammount that you've handed over.

If you have any other form of receipt, whether it be a 'Para Makbuzu', or a hand-written receipt, your payment of the KDV inclusive, should be shown as 'Vergi Dahil'.

If only the work is listed with no mention of Vergi or KDV, then you will not have paid the 18% tax with payment.

Good Luck. 5 years is nothing regarding checking Tax evasion in Turkey, similar to inside Europe really.

Freedom 49 first class post like the UK no VAT shown means no VAT paid and you are both seller and buyer responsible.

If no mention of tax on any of your invoices/payment receipts he could be wanting copies to try to demonstrate to the tax man that he has not yet billed you for the tax and then hit you with an invoice which will get him off the hook. In the UK if you invoice someone without mentioning VAT the person raising the invoice is liable for any VAT payments that are applicable but it may be different in Turkey.

It sounds like he is trying to get the difference between the lessor amount agreed upon than the 3,000 he originally asked for...

Now 5 years on it could be a significant amount with interest and possible fines - time to seek tax/legal advice me thinks...

Be careful with your correspondence in the meantime - it might cost you dear...

Most of the quotes were done over the Internet whilst we were the uk. He would give Us a quote for the work in stages and on completion he would send us pictures and we would pay. Surely the only tax due would be on the labour and not the goods as this tax would be paid when purchasing the goods.
