Selling a property from the UK

Is it possible to sell a property in Turkey from the UK? Can the paperwork be completed in Turkey, posted to the UK for signature and then sent back to Turkey, or is a Power of Attorney needed.

The seller is ill and cannot travel to Turkey. He is going to sell the property for a nominal fee to his brother.

the seller would have to give power of attorney to someone to do this on their behalf ..could be risky.. depends just how much the seller would trust them ..we sold a villa last week it took 10 hours from start to finish..

Yes, a POA would be needed from the seller.
The person named on the POA would then be responsible for accumulating the correct paperwork and ensuring that all debts (building tax, site maintenance, electricity, water etc) were paid up to the date of Tapu transfer.

This representative would then submit everything to the Tapu office on the morning of transfer, and introduce the seller's brother as the buyer.
The seller's brother would be liable to pay the Tax due on the new Tapu (approx 4% of new declared value), and then the new Tapu would be signed for and issued later the same day.

If everything is done correctly, you would have no problem.

The seller wants to give power of attorney to his brother who will transfer the house into his name. Can that be done or does a third party need to be involved??

Yes ,I think I remember something about if a current foreign owner who is in a property who had already gone through Mil clearance & they sell to another foreign owner then its ok now . Is that it ? . [ obviously that was the case selling to a Turkish national I know ]

If a Military Clearance has been granted on a property, it is not needed again.

On a Site where properties have had clearance, no new application is required on further sales.

On a NEW development ( Site ), the first sale to a foreigner will require Military Clearance, ongoing sales will not need this.

If a new property is built on its own land, i.e. NOT on a Site, Military Clearance is still needed if the property is sold to a foreigner that does not have Turkish Citizenship.

Speaking from an Emlak's point of view, I think this is a good move in the right direction it cuts down a lot of waiting time and messing about for our foreign buyers.

Don't forget that the Belediye sets the price that is the minimum you can sell the house for, the actual payment can be nominal but the taxes will be on the declared tapu value, which is stipulated by the belediye.

Got to say that after reading about the problem on here re POA never being revoked and said chappy selling their house I would be nervous issuing POA to anyone! Hope you get it sorted out
