Turkish Condominium Law - Roof repair

Hello. I am sure that under Condominium Law that all owners in a block are responsible for roof repairs not just those on the top level. Can anyone give information on this. I am on base level but am willing to pay my share but need confirmation for others. Thanks in advance,Derek.

I would be very interested in an answer to this also. We are a top floor apartment and in our complex the top floor apartments are solely responsible for maintaining the roof area, or so we have been advised.

You are correct ,we have just had repairs done to our roof in a block of 4 apartments and everyone had to pay equal shares

I have looked through Condominium Law but cannot find any clause relating to this. The site does not have a management plan due to the small number on site.

management plan (MP) is part of the building plan and will be available at the TAPU office. if the site has less than 8 units I believe Condominium law does not apply. Condominium law refers several times to MP

I though management Plan was not required for less than 8 units but that Condominium Law still applied. Willing to be corrected.

I know this is the U.K. But we live in a block of 32 apartments. We are on the ground floor and have to pay our fair share of the roof repairs and the lift, which we don't use. It seems obvious to me that all are responsible for the upkeep of the roof.

I believe that Tosmur is correct and that it states in the Act that the Condominium Law is not applicable to less than 8 units and as the Management Plan requirement is part of this law that also is not a legal obligation.
For those where it is applicable Article 4 defines the mutual parts and they include roofs
